Hellen ve Roma Hukuku`nun modern hukuka yansımaları

Abstract

Çalışmanın amacı Türkiye Cumhuriyeti hukuk sistemi ile bu sistemin temelini teşkil eden Yunan ve Roma hukuk sistemlerini mukayese ederek bu eski medeniyetlerin günümüz hukukuna etkilerini ortaya koymaktır.İnsanlık tarihinin başlangıcından itibaren toplumsal düzeni şekillendirmede her zaman nizami kurallara ihtiyaç duyulmuştur. Bu kuralların varlık kazanabilmesi ve işleyişlerini sürdürebilmeleri hukukun varlığının devamı halinde mümkündür. Bu nedenle hukuki yapılanma devletler tarafından uzun vadeli olabilmek, iç çatışmanın ve kaosun oluşumunu engelleyebilmek adına çeşitli kurallar ve düzenlemeler ışığında uygulamaya konulmuştur.Çalışmaya konu olan Yunan ve Roma Devletleri de hukukun devletin varlığı ve işleyişi üzerindeki olumlu etkisinin farkında olup bu çerçevede kendi değerleri doğrultusunda oluşturdukları hukuki kaidelerle var olmaya çalışmışlardır. Tarihi süreç içerisinde bir takım gelişim ve değişimlerin sonucunda bugünkü şeklini alan hukuk günümüzde de hala aynı önemini muhafaza etmektedir. İşleyişiyle halkın güven ve adalete dair beklentilerine karşılamaya çalışılmış olmakla birlikte toplumda oluşturduğu düzen kurallarıyla da refah seviyesinin arttırılması amaçlanmıştır. The aim of this study by comparing the Republic of Turkey and the Greek and Roman law system, which constitutes the basis of this system with the legal system of this ancient civilization is to reveal the effects of the present law.Since the beginning of human history, regular rules have always been needed to shape the social order. It is possible for these rules to gain assets and to maintain their functioning if the existence of the law continues. For this reason, legal structuring has been put into practice by the states in the light of various rules and regulations in order to be long-term and to prevent the formation of internal conflict and chaos.The Greek and Roman states that are the subject of the study are aware of the positive effect of the law on the existence and functioning of the state and have tried to exist with the legal rules established in line with their own values. The law, which has taken its current form as a result of a number of developments and changes in the historical process, still maintains the same importance today. While it is tried to meet the expectations of the people with respect to trust and justice, it is aimed to increase the welfare level with the rules of order established in the society.Keyword: Hellenic, Rome, Law, Punishment, Justice
