Abstract

ÖZET İslam dininin insan sağlığına verdiği önem yaygın bilinen bir gerçektir. Tıp ilmine İbni Sina gibi nice İslam hekimlerinin unutulmaz katkıları olmuştur. Modern diş hekimliği uygulamaları çok hızlı değişim göstermektedir. Bu sanatın uygulanmasında bazı hukuki problemler ortaya çıkmaktadır. İslam hukukunda değişen tıp tekniklerine uygulanabilecek ana prensipler vardır. Bu çalışmada, zikredilen ana prensipler ışığında, günümüz diş hekimliği uygulamalarına fikhi çözümler getirilmeye çalışılmıştır. Diş hekimliği sanatının icra yöntemleri değişse de, diş hekimlerinin sorumluluğu içerik yönünden fazla değişim göstermemektedir. İslam dininde ödenmesi güç para cezalarıyla insan sağlığına verilebilecek zararların önlenmesi öngörülmüştür. Bu durum insan sağlığına ve haysiyetine verilen önemi vurgulamaktadır. Günümüz koruyucu hekimlik anlayışının ulaştığı neticelerden sonra, İslam'ın ağız sağlığına verdiği önemin kıymeti daha iyi anlaşılmaktadır. vii

SUMMARY The attention that the religion of Islam has paid to human health is a wide known truth. The muslim doctors such as Ibn-i Sina have achieved unforgettable innovations at medical science. The practices of Modern Dental Medicine have shown a rapid growth. Some law problems have arisen during the exercise of this art. In Islamic Law, there exist main principles that can be applied to changing medical techniques. At this study, we have tried to bring solutions to the practices of Contemporary Dental Medicine from Islamic Law (Fiqh) in light of aforementioned main principles. Even though the exercise methods of Dental Medicine Art have been changing, the responsibility of medical dentists does not show much variation from the aspect of context. In the religion of Islam, the possible harms against human health have been dismissed by the virtue of difficult to afford fines. This matter has been considered as an indication of importance for health and honour of human The value of importance which Islam has paid to the oral health has been understood better through the conclusions that Contemporary Preventive Medicine has reached. vui
