dc.description.abstractÖZET İslâm Hukukçuları hadislerden hareketle, faizin hangi mallarda ve hangi şartlarda gerçekleştiğini yani faiz illetinin ne olması gerektiğini tesbit etmeye çalışmışlardır. Buna göre paralarda faiz illeti; Hanefîler ve Hanbelîlere göre, `cinsle beraber tartılır olma özelliği`, Şâfiîler ve Mâlikilere göre, `para olma özelliğinin hakim unsur olması`, bazı fakihlere göre de, `tam para olma özelliği olması` dır. Paraların dışındaki mallarda ise faiz illeti; Hanefîler ve Hanbelîlere göre, `cinsle beraber ölçülür olma özelliği`, Şâfiîlere göre, `gıda olma özelliği`, Mâlikilere göre, `stoklanabilen gıda olma` dır. Ancak söylendiği devrin şartlan için uygun olabilen bu faizde illet anlayışları günümüz iktisadî ve ticarî hayatına tam uyum sağlayamamaktadır. Buna göre, günümüzde ticarî ve iktisadî hayatımıza cevap verebilecek faiz illeti `cinsle beraber mislî mal olmadır`. vıu
dc.description.abstractSUMMARY By taking reference the words and the deeds of the prophet Muhammad, the Islamic lawyers and the academicians tried to determine that the goods and the circums tances in which the interest happens, in other words, they tried to find out the rate of interest disease. These works showed that the rate of interest in the four basic paths or the doctrines in Islam is interpreted as in the following: `It should be weighable with the main source` in the dominant factor should be monetary` in the doctrines of Shafii and Maliki. And finally `it should be expressed as absolute money` in the interpretations of some experts in the canon law of Islam. The interest disease for the goods except monetary can be expressed as in the following: From the point of the doctrines of Hanafi and Hambali ` it should be countable with the main source`. And from the point of the doctrine of Shafii `it has to be food`. And finally from the point of the doctrine of Maliki ` it has to be a food and can be made stocks of it`. The expressions for the interest disease may be suitable at that time, but are not suitable for today's commercial and financial life. Finally, what we can suggest for the interest disease, which can be suitable today's financial and commercial applications is `the multiples of the same sort of the goods`. IXen_US
