Güvenlik hizmetlerinin yürütülmesinde polis-adliye ilişkileri (Adapazarı örneği)

Abstract

TÜRKÇE ÖZET `Güvenlik Hizmetlerinin Yürütülmesinde Polis-Adliye İlişkileri`: Adapazarı Örneği adlı bu çalışmada; Türkiye'de güvenlik hizmetlerinin yürütülmesinde polis-adliye ilişkilerinde, karşılaşılan sorunlar ve çözüm önerileri ortaya konmaya çalışılmıştır. Ceza adalet sistemi işleyişinde iki önemli kurum olan polis-adliye ilişkilerini incelemek üzere, Adapazarı adliyesinde kesinleşmiş ceza davaları üzerinde inceleme yaparak, emniyet hizmetlerinin adalet hizmetlerine katkısı ve karşılıklı etkileşimleri belirlenmeye çalışılmıştır. Bu araştırmada betimsel araştırma yöntemleri kullanılmıştır. Ayrıca Adapazarı adliyesinde Ağır ceza, Sulh ceza ve Asliye ceza mahkemelerine ait 100 hükmü kesinleşmiş ceza davası örneği incelenmiştir. Araştırma sonucunda; suçların yoğun olarak işlendiği yerlerin Emniyet Teşkilatı görev alanına giren yerleri olduğu görülmüştür. Örnek inceleme alanlarında, sanıkların CMUK'da belirtilen sanık haklarından, özellikle avukatın hukuki yardımından çok az yararlandıkları ve suçla ilgili olarak sanık kinıliğinin belirlenmesi sırasmda teknik yetersizliklerden kaynaklanan sorunlar yargılama safhasının uzamasına neden olduğu görülmüştür. SUMMARY İn this study titled Adapazarı Example of the Police and the Court Relations in Carrying out Security Services, it was aimed to determine the problems encountered in the relations between the police and the court in performing the security services in Turkey and the suggestions to solve these problems. The criminal lawsuits in Adapazarı Lawcourt were examined to study the police and the cour relations, which are two important institutions in conducting the crime and justice system. în this study, the method of descriptive research was used, and examples of 100 decisive criminal lawsuit decisions which were judged in Major Punishment, justice Punishment and Fundamental Punishment Courts in Adapazarı were examined From this study, it was concluded that the spots where crimes were most densely committed were those within the responsibility area of the police. İt was seen that suspects benefited very little from the suspects rights which are defined in Criminal Procedure law (CMUK), especially from the legal advice of the lawyer and that the problems arising from the lack of sufficient technical devices in determining the identification of the suspects led to a lengthening in the period of judging the suspect.
