Yerel demokrasi açısından belediye meclislerinin statüsü ve işlevi

Abstract

ÖZET Demokratik yerel yönetim anlayışında üzerinde durulan konulardan biri de belediye meclislerinin statüsü ve işlevidir. Belediye meclislerinin önemli özelliklerinden biri de yerel özerkliktir. Bugün demokratik sistemde belediye meclisleri merkez karşısında bağımsızlığını sağlamış ve kanıtlamıştır. Ülkemizde ise köklü ve güçlü yerel yönetim geleneğinin olmadığı söylenir. Çünkü ülkemizde yerel demokrasi, tabandan gelen bir istekle değil, tepeden inme bir hareketle oluşturulmuştur. Bu sebeple, kuruluşlarından bu yana yerel yönetimler merkezi yönetimin yoğun vesayet denetimine maruz kalmışlardır. Belediye meclisleri de diğer yerel yönetim birimleri ile aynı kaderi paylaşmıştır. Öte yandan belediye meclislerinin temsil sorunu ile de karşı karşıya olduğu bilinmektedir. Bütün bunların yanında belediye meclislerinin özerklik ve yetki açısından yetersiz olduğu belirlenmiştir. Çalışmamız, ülkemizde belediye meclislerinin yerel demokrasi açısından konumunu irdelemeye çalışmaktır. Konuyla ilgili çözüm önerilerini dile getirmektir. Araştırmamızı yerel yönetimlerin dünyada ve ülkemizde tarihsel gelişim süreçleri ile başlattık. Bu bağlamda bizde yerel yönetim geleneğinin Tanzimat sonrası modernleşme çabaları ile birlikte başladığı gözlemlenmektedir. Tanzimat'tan günümüze yerel yönetimler yerel özerklik açısından gelişme göstermişse de gelişmiş ülkelerin yerel demokrasilerinin seviyesinde olmadığı saptanmıştır. Sonuç olarak bir yerel yönetim birimi olan belediye meclisleri, batılı anlamda demokratik yerel yönetim anlayışı gereği tam anlamıyla özerkliğini gerçekleştiremediği belirlenmiştir. Ülkemizde yerel yönetimlerin merkezin yoğun idari vesayet denetimine tabi tutulduğu görülmektedir. Gerek halk katılımı gerekse temsil açısından toplumdaki tüm grupları eşit düzeyde meclis üyeliğinde temsil edemediği tespit edilmiştir. Bunun yanında belediye sistemi içerisinde belediye başkanlarının zamanla belediye meclisleri karşısında güç kazandığı da araştırmamızda gözlenmiştir. IX

SUMMARY One of the most important subject in democratic local administration is the status and function of the councils of municipalities. One of the important characteristics of the councils of municipalities is local autonomy. Nowadays, in democratic systems, councils of municipalities have gained and proved their independence from the central government. It is said that there is no powerful and fundamental local administration traditions in our country. Because democracy in our country has not been formed for the good of the people. It has been formed by the force of the central administrators for this reason thus, orders coming from high offical-local administration have been kept under tutelage of the central administration. Councils of municipalities have faced the same desting like other local administrations. On the other side, it is know that councils of municipalities have problems of represantation. It has been pointed out that councils of municipalities are inadequate from the point of view of autonomy and authority points of viewes. In this study, the situation of local democracy and it's effects on councils of municipality has been searched. It has been emphasized that there should be some solutions for this problem. It has been observed that local goverment tradition has begun during (Ottoman) reformation age and, of course, it can be said that it happened because of renewal movements. From Ottoman reformation until today local goverment- from the autonomy point of view this developent was not as big as the developments in developed countries. As a result, municipal administrations that are units of local goverment, have not gained their authonomy entirely. In our cuntry, local goverments have been kept under tutelage of the central goverment. It has been, observed that neither people nor other groups have not been represented enough in municipal administration. Besides, certain clues are gathered on the increasing role of the mayors at the expense of the mayors and at the expense of the municipal administration. X
