Sun`ullah Efendi`nin Fetâvâ`sı ve tahlili

Abstract

Sun'ullah Efendi 960/1553 yılında İstanbulda doğmuştur. Babası Kanuni Sultan Süleyman dönemi kazaskerlerinden İskilipli Molla Cafer Çelebi'dir. Müderrislik ve kadılık yapan Sun'ullah Efendi 1008/1599 senesinde şeyhülislamlığa başlamıştır. Görevinin ilk iki dönemi III. Mehmed, üçüncü ve dördüncü dönemi ise I. Ahmed devrine denk gelmektedir. Çeşitli sebeplerle dört defa azledilerek tekraren göreve getirilmesiyle tarihe geçmiştir. Dördüncü ve son azlinden sonra inzivaya çekilmiş ve 1020/1611 yılında hacca gitmiştir. Hacc dönüşünden kısa bir süre sonra 1021/1612 senesinde İstanbul'da vefat etmiştir. Eserimiz Fetâvâ-yı Sun'ullah Efendi de 16. yüzyıla ait bir fetva mecmuasıdır. Mecmuada Sun'ullah Efendi'ye arz edilen ve onun tarafından cevaplanan fetvalar derlenmiştir. Eserin farklı yerlerde nüshaları mevcuttur ancak bizim esas aldığımız nüsha Süleymaniye Kütüphanesi'nde bulunan nüshadır.Eser içerisindeki fetvalar konusuna göre farklı bablara ayrılmıştır. Babların sistematiği klasik fıkıh sistematiğine uygundur. Kitabu't-tahâre ile başlayıp Kitabu'l-vesâyâ ile son bulmaktadır.Sun'ullah Efendi sorulara genellikle kısa cevaplar vermiştir. Eserdeki cevapların büyük bir kısmını tek kelimelik cevaplar oluşturmaktadır. Gerekli gördüğü yerlerde ise bazen uzun bazen kısa açıklamalar yapmıştır. Eserde nakil yoktur ancak Sun'ullah Efendi'nin nadiren de olsa alim veya mezhep imamlarına atıfta bulunduğunu söylemek mümkündür. Eserde Sun'ullah Efendi genel olarak net cevaplar vermiştir. Farklı görüşlere atıfla fetva verdiğinde ise genellikle tercihini belli eden ibareler kullanmıştır. Tercihte bulunmadığında ise meseleyi bazen hakimin bazen de sultanın takdirine bırakmıştır.Mecmuamızda Sun'ullah Efendi'ye ait 1017 fetva bulunmaktadır. Toplamda 79 varaktan oluşan eserimizde Sun'ullah Efendi'nin fetvaları 76. varakta son bulmaktadır. Diğer varaklarda ise mârûzât bölümü mevcuttur.

Sun'ullah Efendi was born in 960/1553 in Istanbul. His father was Molla Cafer Çelebi of Iskilip who was one of the kazasker during the reign of Kanuni Sultan Süleyman. Sun'ullah Efendi, who was a mudarris and kadi, began to work as Shaykh al-Islam in 1008/1599. The first two periods of his service corresponded to Mehmed III era, and the third and fourth periods corresponded to Ahmed I era. He went down in history by being dismissed and recommissioned because of several reasons for four time. After his fourth and last dismissal he retired into seclusion and went on pilgrimage in 1020/1611. He died after a little while he returned from his pilgrimage in Istanbul in 1021/1612. And the piece Fetâvâ-yı Sun'ullah Efendi is a fetwa journal which is from the 16th century. The fetwas which were submitted to Sun'ullah Efendi and answered by him are compiled in the journal. There are several copies of the piece in different places, but the copy we based our work on is the one in the Süleymaniye Library. Fetwas in the journal are divided into different babs according to their subjects. Systematics of the babs match with the classical fiqh systematics. It starts with Kitabu't-tahâre and ends with Kitabu'l-vesâyâ.Sun'ullah Efendi usually gave short answers to the questions. A great majority of the answers in the piece are consisted of one-word answers. He made both brief and long explanations whenever he deemed it necessary. There are no quotations in the piece, however it can be said that, even though it's seldom, Sun'ullah Efendi cited some scholars and madhhab imams, too. Sun'ullah Efendi generally gave straight answers in the piece. He usually used expressions which indicated his preference, when he gave a fetwa with a reference for different opinions. And at the times when he didn't make any preferences, he left the issue to the judge's or the sultan's discretion. In the journal there are 1017 fetwas which belong to Sun'ullah Efendi. In the piece, which is consisted of 82 foils, the fetwas of Sun'ullah Efendi end in the 78th foil. And there is the submission section in the remaining foils.
