Havacılık sektörü yatırımları ve hukuksal sorumluluklar

Abstract

Havacılık, uçakların; tasarımı, geliştirilmesi, üretimi, işletilmesi ve kullanımını kapsayan, havada uçma eyleminin (aeronautics) pratik yönü veya sanatıdır. Çalışmamızın ilk bölümünde, bu sektördeki taşımacılığın dünyada ve ülkemizdeki mevcut durumu, kurumları ve işlevleriyle ele alınmaktadır. Çalışmanın ikinci bölümünü, bu sektöre yapılan yatırımlar oluşturmaktadır. Bu sektördeki ekonomik ve finansal yapı, küresel ve bölgesel bağlamda ele alınmaktadır. Çalışmanın üçüncü ve son bölümünde, sektörün işleyişinin hukuksal yönünü ele alınmaktadır. Hava Taşıma Sözleşmesi çerçevesinde, hukuksal boyut; taraflar ve bunların sorumlu oldukları ya da olmadıkları yönler değerlendirilmektedir. Çalışma sonucunda, havacılık sektöründe veya sektörle ilgili paydaşlar tarafından, ekonomik ve sosyal büyümenin yanı sıra, sürdürülebilir ve tedbirli çevresel davranışın önemli olduğu görülmektedir.

Aviation is the practical aspect or the art of the act of flying in the sky (aeronautics) including the design, development, operation and the use of the airplanes. In the first part of our study, the current status of the transportation in this sector in the world and in our country is discussed with the institutions and the functions. The second part of the study is consisted of the investments made for this sector. The economical and financial structure of this sector is discussed in the cultural and regional context. In the third and last part of the study, the legal aspect of the operation of the sector is discussed. Within the frame of the Air Freight Agreement, the legal aspects, the parties and the matters regarding, which they are liable or they are not liable, are evaluated. As a result of this study, it is seen that as well as the economical and social growth, the sustainable and prudent environmental behaviors are considered important in the aviation sector or by the shareholders related to the sector.
