Vekalet teorisi çerçevesinde bağımsız idari otoriteler: Bankacılık Düzenleme ve Denetleme Kurulu

Abstract

Çalışmanın amacı sosyal bilimler literatürümüzde kendisine çok fazla yer bulamayan vekalet teorisini tanıtmak ve uygulanabilirliğini göstermektir. Esas itibariyle, biri diğeri için hareket eden iki aktörün var olduğu her türlü ilişkiye uygulanabilen vekalet teorisi, sosyal hayatın tüm alanlarına uygulanabilme özelliğine sahiptir.Vekalet teorisini kavramsal olarak ifade etmenin yanı sıra, bu kavramların tam olarak neyi ifade ettiğini gösterebilmek için teori uygulamaya dökülmüştür. Bu bağlamda seçilen suje, Bankacılık Düzenleme ve Denetleme Kurulu, teorinin temel varsayımları açısından incelenmiştir.Çalışmada, Bankacılık Düzenleme ve Denetleme Kurulu'nun, vekalet teorisi açısından, gerek asil gerekse vekil olarak oynadığı her iki rolünde gereklerini yerine getirdiği sonucuna varılmıştır. Ancak; asıl varılan sonuç, vekalet teorisinin, sosyal bilimler açısından önemli, işlevsel ve üzerinde yeni çalışmalar yapılmasını gerektiren bir konu olduğunun ortaya çıkmasıdır.Anahtar Sözcükler1. The aim of the study is; to explain and indicate applicability of the theory which can not find too much place in our social sciences literature. Essentially, when there are two actors -one acting in behalf of the other as agent- the theory can be applied to any relationship. For this reason, the theory capable of applicability to all areas of social life.As well as to express the principal agent theory as a conceptual, to show exactly what these concepts mean, the theory has arisen to implement. In this context, the chosen subject, the Banking Regulation and Supervision Agency is examined in terms of fundamental assumptions of the theory.In the study concluded that; the Banking Regulation and Supervision Agency has fullfilled the requirements of the role, played by both as principal and agent, in terms of agency theory. However, the main conclusion is the principal agent theory, a topic that requires new studies on the functional and the emergence of that in terms of social sciences.Key Words1.
