Radyo Televizyon Üst Kurulu ve kararlarının yargısal denetimi

Abstract

Bu tezin konusu, kısa adı RTÜK olan Radyo Televizyon Üst Kurulu ve kararlarının yargısal denetimidir. Hukuk sistemimiz için henüz çok yeni bir kavram olan bağımsız idari otorite çerçevesinde, yine yeni bir kurum olan Radyo Televizyon Üst Kurulu'nun idari yapı içindeki yerini ortaya koymaya çalışılmıştır. Çalışmanın amacı, Radyo Televizyon Üst Kurulu'nu analiz etmek ve kararlarının hukukiliğini tartışmaktır. Ancak üst kurulun kararlarında sınırlamaya gidilerek yayın ilkelerine aykırılıklarla , lisans ve reklamlara ilişkin kararlar incelenmiş, Kurulun iç işleyişiyle ilgili kararları araştırma dışı bırakılmıştır.Yukarıda sıralanan çerçeveden hareketle bağımsız idari otorite kavramı, bağımsız idari otoritenin özellikleri ve işlevleri, regülasyon yetkisi ile RTÜK'ün idari yapı içindeki yeri, görev, yetki, teşkilat ve denetimden bahsedilerek, Kurulun bağımsız idari otorite olması yönü değerlendirilmiştir. Bununla birlikte, Kurulun kararlarının yargısal denetimi irdelenmiştir

The subject of this thesis is the Radio and Television Supreme Council, whose acronym in Turkish RTÜK and judicial control of the supreme council?s decisions. In the fundemental characteristic limits of the indepentent administrative authority which is a very new concept for our law system is studied to bring up the Radio and Television Supreme Council which is also new establishment in our administrative structure. The aim of this study to analyze the Radio and Television Supreme Council and to discuss the legality of the supreme council?s decisions. To have limited the supreme council?s decisions, the decisions related to violations of the broadcast principles, licenses and advertisements are stuided carefully, nevertheless transactions concerned with internal administrating are not researched.Depending on tehe aforementioned frame to have mentioned conceptof the indepentent administrative authority, characteristics and functions conceptof the indepentent administrative authority, its regulation authority and the place of the administrative structure of the Radio and Television Supreme Council, mission, authority, organization and control of the supreme council, Radio and Television Supreme Council?s side which is the indepentent administrative authority are evaluated. Besides, judicial control of the supreme council?s decisions are researched.
