Abstract
İş güvenliği, mesleki risklerin önlenmesi için gerekli olan tedbirlerin alınmasını zorunlu kılan, önlenemediği durumlarda bundan zarar görenin kusurlu olan taraftan zararının giderilmesini talep imkanın, veren bir kavramdır.Tarih boyunca çeşitli aşamalardan geçen iş güvenliği kavramı sanayileşme ile birlikte ve ilk önce çocukları ile kadınları koruma amacıyla çıkmış fakat, ancak etkin bir denetim sistemi ile desteklendikten sonra gerçek anlamı ile fayda sağlamaya başlamıştır.İş güvenliğinin sağlanması için iş ilişkisinin taraflarına ve devlete çeşitli görevler düşmektedir. Devlete düşen en önemli iki görev mevzuat hazırlama ve denetim faaliyetini yürütmedir. Devlet, iş mevzuatında son dönemde yaptığı değişikliklerle mevzuatı AB ve ILO normları ile yeknesaklaştırmaya çalışmıştır. Bunu iş güvenliği alanında da görmekteyiz.Son dönemde yapılan değişikliklerle eğitim, işyeri organizasyonu ve işçilerin katılımı gibi konulara önem verildiği görülmektedir. Bu değişikliklerle aynı zamanda işverene oldukça fazla yük yüklendiği de göze çarpmaktadır. İşveren mevzuattaki tüm iş güvenliği önlemlerini alma zorunluluğu yanında bilim ve teknolojinin son ilerleme noktasında alınması gereken önlemleri de almak zorundadır. İşverenlerin, böyle bir yükün altından çoğu zaman tek başlarına kalkmaları beklenemez. İşverenlere ve hatta diğer iş güvenliği taraflarına yol gösterici olmak bakımından bir iş güvenliği enstitüsü kurulması ciddi bir gerekliliktir.İş güvenliğinde tazminat davaları bakımından kaza ile fiil arasında iş ile ilgili olma şeklinde aranacak olan illiyet bağının tespitinde klasik işyeri ve iş zamanı kavramları artık yetersiz kalmaktadır. Çünkü çalışma şekillerinin geldiği karmaşıklık düzeyi, sürekli değişim ve değişimin gelinen noktada vardığı hız; bunun yanında yeni çalışma şekillerinin getirdiği esnek çalışma biçimleri, klasik anlayışın iş güvenliğinin sağlanması ihtiyacına sağlıklı bir cevap vermesini engellemektedir. İşverenin hukuki sorumluluğu bakımından bu anlamıyla illiyet bağı arandığında iş organizasyonu kavramı klasik anlayışa nazaran daha doğru olacaktır. Occupational safety is a concept that entails taking the necessary precautions to prevent the occupational risks; that provides victim the opportunity to request indemnification from who makes the mistake, when they are not prevented.The concept of occupational safety, which has undergone various phases throughout the history, appeared together with industrialization first to save women and children; however, it started to provide benefits substantively only after it had been supported by an efficacious inspection system.For provision of occupational safety, there are various duties for the parties to the business and for the state. Two most important duty of the state are preparing legislation and executing supervision. With the recent changes made in law of occupation, the state has tried to make the legislation monotonous with the norms of EU and ILO. We see this in the sphere of occupational safety as well.It is seen that with recent changes, some subjects, like education, work place organization and workers participation, are given importance. With these changes at the same time it draws the attention that employer is burdened heavily. Besides the imperative of taking all precautions in legislation related to occupational safety, employer has to take the necessary precautions related to the most advanced science and technology. Most of the time it is not expected from the employers to overcome such high level of burdens. In order to give a lead not only to the employers but also to the other parties of occupational safety, it is a severe necessity to establish an institute of occupational safety.Traditional concepts of working place and working time are no longer sufficient in determining the causality which is going to be investigated between accident and act about actions for compensation in occupational safety. Because the level of complexity of types of working, continuous change and speed of change at the moment and flexible working types brought by new forms of working prevent the traditional comprehension to sufficiently satisfy the need to provide occupational safety. In search of causality with regard to employer?s legal responsibility, the concept of occupational organization would be truer than traditional comprehension.
