Abstract
Özel hukuk sözleşmesi, birden fazla hukuk sistemi ile ilişkiliyse yabancılık unsuru kazanmakta, bu durumda, sözleşmeye uygulanacak hukukun belirlenmesine ihtiyaç duyulmaktadır. Yabancı unsurlu sigorta sözleşmelerine uygulanacak hukuk, Türk hukukunda 5718 sayılı Milletlerarası Özel Hukuk ve Usul Hukuku Hakkındaki Kanun m. 24'teki genel hükümlerle, Avrupa Birliği hukukunda Roma I Tüzüğü m. 7'deki özel hükümlerle düzenlenmiştir.Çalışmanın amacı, Avrupa Birliği'nde yapılan çalışma ve düzenlemelerin, hem genel ve hem de Türkiye perspektifinden incelenmesi, bu kapsamda Türk hukukunda gelecekte yapılması gereken ve beklenen yeni bir düzenlemeye ışık tutulmasıdır.Bu kapsamda, bu çalışmada 1. bölümde sigorta hukuku ile Türk hukukunda ve karşılaştırmalı hukuktaki sigorta sözleşmeleri, Avrupa Sözleşme Hukuku İlkeleri ve Avrupa Sigorta Sözleşmesi Hukuku İlkeleri, 2. bölümde yabancılık unsuru ile Türk, Anglo Sakson ve Avrupa Birliği hukuklarında yabancı unsurlu sigorta sözleşmelerine uygulanacak hukuk kuralları, gelecekte kabul edilmesi beklenen Avrupa Sigorta Sözleşmesi Hukuku İlkelerinin tercihe bağlı bir metin olma özelliği ve politik geleceği incelenmiş, son olarak Avrupa Birliği hukukunda ve Türk hukukunda edinilen tecrübeler ışığında bir değerlendirme ve Türk hukukuna yönelik bir düzenleme teklifi ortaya konulmuştur. When a private law contract is in relation with more than one legal system, it is considered as having a foreign element, and thus it is needed to determine the law applicable to the contract. Applicable law to insurance contracts having the foreign element is regulated by the general provisions of Article 24 of Code on Turkish Private International and Procedural Law, numbered 5718, in the Turkish law and by special provisions of Article 7 of the Rome I Regulation, dated 2008, in the European Union law.The purpose of this study is to examine the work and regulations of the European Union both within the general and Turkish perspective and, within this context, to offer an insight for possible and expected regulations in the Turkish law. In this context, this study analyzes insurance law and the insurance contracts in the Turkish law and in comparative law, The Principles of European Contract Law and The Principles of European Insurance Contract Law in Chapter 1, the foreign element and the applicable law to the insurance contracts having the foreign element in the Turkish law, in the Common Law and in the European Union law, The Principles of European Insurance Contract Law as an optional instrument expected to be enacted in the future and its political future, and finally an evaluation within the light of experiences gained in the European Union law and the Turkish law and a proposal for an article in the Turkish law in Chapter 2.
