Abstract
Sosyal hizmette değerlendirme, uygulamanın önemli aşamalarından biridir. Değerlendirmenin nasıl yapıldığı sonrasında yapılacaklar için temel belirleyicilerden olmaktadır. Bu araştırmada amaç, adli görüşme odalarında ifade alma süreçlerinin, mağdurlar üzerindeki psiko-sosyal etkilerinin ortaya çıkarılmasıdır. Adli görüşmecilerin bu süreçle ilgili değerlendirme, karar alma ve diğer adli personelle iş birliğine gitmeleri mağdurun iyiliği için önemli olmaktadır.Araştırmaya, adli görüşme odalarında mağdurlarla görüşme gerçekleştiren farklı mesleklerden 12 adli görüşmeci katılmıştır.2 adli görüşmeci haricindeki diğer katılımcılar en az yedi yıldır adli sosyal hizmet alanında çalışmışlardır. Adli görüşmecilere, demografik bilgilerin de yer aldığı, adli görüşme odalarının, amaç ve hedefleri, görüşme sürecinde adli görüşmeci-mağdur ilişkisinin boyutları ve adli görüşmeci ile diğer adli personel arasındaki mesleki ilişki ve etkileşim konularında sorular içeren görüşme formu verilmiştir. Elde edilen dokümanların değerlendirilmesinde betimsel analizden yararlanılmıştır.Araştırmaya Eskişehir Adliyesinde görevli 7 sosyal hizmet uzmanı, 3 pedagog ve 2 psikolog katılmıştır. Görüşmecilerin 8'i kadın, 4'ü erkek olup yaşları 26 ile 42 arasında değişmiştir. Katılımcılardan ikisi tezli yüksek lisans ve tezsiz yüksek lisans mezunu olup diğer bütün katılımcılar lisans mezunudur. Katılımcıların tümü, lisans eğitimleri süresince bireyle görüşme tekniklerini içeren bir eğitim almış, etik ve ikilemler ile ilgili dersler görmüşlerdir. Adli görüşmeciler, sosyal hizmet, psikolog ve pedagoglardan oluşmalarına rağmen adli sosyal hizmet alanında ortak kurumsal sorumluluklar taşımaktadırlar.Adli görüşmeciler, değerlendirme ilişkisi bağlamında, mağdurun durumunu, mağduriyetin nedenini ve mağdurun yaşantısını anlamaya yönelmişlerdir. Mağdurun durumunu anlamada, empatik duygular ve ahlaki normlar çerçevesinde değer biçme olurken; mağdurun yaşantısını ve mağduriyetin nedenini anlamada, dosyadan ve görüşmelerden elde edilen bilgiler söz konusudur. Buradaki bilgiler doğrultusunda, mağdurla ilgili bir şablon çizilmekte, bu bilgiler hukuk otoriteleri (hâkim/savcı) ile paylaşılmakta ve mağdurun ihtiyaç ve beklentilerine göre bir ifade alım süreci başlatılmaktadır. İfade alım sürecinde elde edilen bilgilerin tamamen mağduru koruma amacıyla değil, yasa ve yönetmeliğe uyma amacıyla kullanıldığı görülmüştür.Adli görüşmeciler, adli görüşme odaları ile ilgili görüş ve önerilerini net ve açık bir şekilde ifade etmişlerdir. Mağdurlarla ilgili kararlarda, olabildiğince savcı-hâkimle iş birliğine gidip mağdurun süreçten zarar görmemesine dikkat etmişlerdir. Mağdurların, ifadesi alınırken, rapor yazılırken ve tedbir önerilirken izledikleri yöntem etik ilkeler ve yasal adımlarla örtüşmüştür. Bunların yanı sıra adli görüşmeciler, bütün görüşme aşamalarını mağdurların yararına yönelik yapmaya çalıştıklarını belirtmişlerdir. In the area of social work, assessment is an important step of implementation. The way assessment is done will be a fundamental determining factor for the other steps. The aim of this research is to reveal the effects of interrogation processes in judiciary interview room (psychosocial) on the victims. Because of this, judiciary interviewers should be in collaboration with other judiciary personnel, in matters like assessment and decision-making, for the best interest of the victims. 12 judiciary interviewers who are from different occupational stuff participated in this research. They had interviews, with the victims in the judiciary interview rooms. Apart from two judiciary interviewers, other participants have worked in the area of judiciary social work for at least seven years. These participants were provided with a form including questions about; demographic information, the purpose and aim of judiciary interview rooms, the different dynamics of the relations between the interviewer and the victim during interview process, and the occupational relationship and interaction between the judiciary interviewer and other judiciary personnel. The descriptive analysis was used in evaluating the obtained documents.7 social workers, 3 pedagogues and 2 psychologists working in Eskişehir Court of Justice participated in this research. 8 of participants are women while 4 of them are men. The year of their ages are in between 26 and 42. Two of the participants are graduates of master's program with and without thesis, while all others hold undergraduate degrees. During their undergraduate degrees, all of the participants were trained for the techniques of interviewing an individual and took courses about ethics and dilemmas. Although judiciary interviewers consist of social workers, psychologists and pedagogues, they all have responsibilities in the area of judiciary social work.In the context of assessment, judiciary interviewers are inclined to focus on the situation of the victim, the reasons of victimization, and the life of the victim. Understanding the situation of the victim involves assessment with empathic emotions and moral norms; understanding the life of the victim and the reasons of victimization involve the information gather from the dossier and the interviews. In the light of that information, a template about the victim is determined and the information is shared with other legal authorities, and then an interrogation procedure is started in line with the needs and expectation of the victim. It has been observed that the process of information gathered, and interviewing is not done for the sole purpose of protecting the victim; it is done with the purpose of following the law and regulations. Judiciary informants clearly expressed their opinions and suggestions about the judiciary interview rooms. In the decisions concerning the victims, they have paid attention to establishing collaboration with prosecutors and judges in order to prevent any harm to the victims. The methods of taking statements from the victims, of writing reports and of suggesting protections are all in line with ethical principles and legal steps. All informants had stated that they watch out for the best interest of the informant during judiciary interviews.
