Abstract
Bir davanın tarafı konumunda olan kişilerin, bu davaya sulh yoluyla sonvermesi, davanın bir mahkeme kararı ile son bulmasına nazaran bazı avantajlar taşır.Taraflar sulh yoluyla aralarındaki uyuşmazlığa hızlı ve ucuz bir biçimde sonverebilirler. Ayrıca bu durumda, tarafların sosyal ilişkilerini muhafaza etmesi,uyuşmazlığın mahkemenin vereceği bir kararla çözümlenmesi ihtimaline kıyasla dahaolasıdır. Bunların yanı sıra sulh olan taraflar, aralarındaki uyuşmazlığa ilişkin maddihukuk kuralları ile bağlı olmaksızın istedikleri şekilde anlaşabilirler. Yani taraflar sulhile yalnızca hak temelli değil, menfaat temelli çözümler üzerinde de uzlaşabilirler. Buise tarafların hareket ve etki alanını artırarak, uyuşmazlığın çözümü bakımındanonlara kolaylık sağlar. Bunlara ilaveten; sulhe davanın tarafı olmayan üçüncü bir kişikatılımı, dava konusu olmayan hususların sulh kapsamına alınması ve şarta bağlı sulhyapılması mümkündür (HMK m. 313).Yukarıda sayılan faydaları nedeni ile davaların sulh yoluylasonuçlandırılması teşvik edilmelidir. Ne yazık ki, ülkemizde sulh ile sonuçlanandavaların sayısı oldukça azdır. Bu durumun; toplumdaki uzlaşma kültürüeksikliğinden mahkemelerde sulhe teşvikin gereğince yapılmamasına, tarafların sulhile ilgili yeterince bilinçli olmamasından mevzuattaki sorunlara kadar bir dizi nedenivardır. Yine yargının içinde bulunduğu iş yükü yoğunluğu bu durumun bir diğernedenidir. Çünkü tarafların sulhe teşviki için hakimin aktif bir tutum takınmasıgerekir. Yoğun iş yükü altında çalışan mahkemelerin ise bu görevi gereğince ifaetmesi mümkün görünmemektedir. Çalışmamızda, faydaları yukarıda sayılan sulh geniş bir incelemeye tabitutulacak ve sulhün işlevsel hale getirilmesi için bazı önerilerde bulunulacaktır. It is a fact that when the parties of a case end their dispute through asettlement agreement, they obtain some advantages compared to when the caseends with a court ruling. The parties may finish the dispute between themquickly and inexpensively via a settlement agreement. Also, in this case, it ismore likely that the parties maintain social relations, in comparison with thepossibility that the dispute will be resolved with a court ruling. In addition tothese, the parties, who reach a settlement agreement, can agree as they desire,irrespective of the substantive laws applied to the dispute between them. Thatis, the parties can accept not only right based solutions but also interest-basedsolutions through settlement agreement. This facilitates the settlement of thedispute by increasing the scope of action and influence of the parties.Additionally; the participation of a third person who is not a party to the caseof the defendant, the inclusion of issues which the parties did not bring to thecourt in the scope of settlement agreement and a peaceful settlement withconditions may be possible (HMK 313).Considering the above-mentioned benefits, the parties should beencouraged in favour of the settlement of cases via agreement. Unfortunately,the number of cases that resulted by settlement agreement in our country isquite small. There are a number of reasons why the parties do not have resortto conclude a settlement agreement such as lack of reconciliation culture in oursociety, the fact that the courts do not encourage the parties, lack of awarenessof the parties and the problems in the legislation. Yet another reason for this isthe intensity of the workload in which the judge is involved. Since the judgeneeds to take an active attitude to encourage the parties to conclude asettlement agreement, it is not possible for courts operating under heavyworkload to perform this task properly.In this study, the settlement agreement, the benefits of which listedabove, will be thoroughly reviewed
