Tarihsel, kuramsal ve hukuksal boyutlarıyla fahişelik ve seks işçiliği

Abstract

Cinsel hazzın satılması ile farklı bir anlam kazanan seks ve bununla birlikte ortaya çıkan fuhuş kavramı tarihin ve günümüzün en çok tartışılan meselelerinden biridir. En genel tanımı ile fuhuş, maddi kazanç sağlamak amacıyla tekrarlı cinsel ilişkide bulunmaktır. Fuhuş sektörü içerisinde yer alanların tanımlanması, hukuksal ve sosyo-ekonomik koşulları, işçi olarak kabul edilip edilemeyeceği sosyal bilimlerde önemli bir tartışma konusu olarak güncelliğini korumaktadır. Bu tez çalışması ticari seks içerisinde yer alanların işçi olduğu varsayımına dayanarak kavramsal ve hukuksal bir tartışma yapmaktadır. Bu bağlamda seks işçilerinin örgütlenme olanaklarını da araştırmaktadır. Bu nedenle bu çalışma beden, arzu, haz gibi kavramları içeren ahlaksak bir tartışmaya dayanmamaktadır. Tezin temelini halen seks işçisi olarak çalışan kişilerle yapılan yarı yapılandırılmış görüşmeler oluşturmaktadır. Anahtar Kelimeler: fahişe, fuhuş, seks işçiliği, örgütlenme, sendika, ticari seks.

While sex has gained a different meaning with the commercialization of sexual pleasure, the concept of prostitution has become one of the most debated subjects both historically and currently. In its most general definition, prostitution is the practice of engaging in sexual activity for money. Definition of the people who take part in the business of prostitution, their legal and socio-economic conditions, whether or not they can be accepted as workers are still current subjects of debate.This thesis is based on the assumption that those who work in the business of commercial sex are workers, and makes legal and conceptual arguments while exploring the possibilities of organizing among sex workers. In other words, this study does not make any arguments involving morality based on the concepts such as body, desire and pleasure. Semi-structured interviews conducted with individuals who still work as sex workers constitute the foundation of this thesis.Keywords: prostitute, prostitution, sex labour, organizing, union, commercial sex.
