Taşıyanın yanlış konşimento düzenlenmesinden sorumluluğu

Abstract

Konşimentonun eşyayı temsil eden bir kıymetli evrak olması onu deniz yoluyla eşya taşımalarında kullanılan diğer evraklar arasında önemli bir yere konumlandırmaktadır. İlgili kanunlarda her ne kadar talep üzerine düzenleneceği öngörülmüşse de konşimento düzenlenmeden gerçekleştirilen bir eşya taşımasına çok nadir rastlanır. Bunun sebebi hem eşya hala gemi üzerindeyken satış işleminin ancak konşimento sayesinde yapılabilmesi hem de akreditif ya da vesaik mukabili gibi ödeme biçimlerinde kullanılması zorunluluğudur. Elbette konşimentonun bu denli öneme haiz olması doğru düzenlendiğine duyulan güven gereksinimini de beraberinde getirmektedir. Bu sebeple taşıyan kanun hükümleri uyarınca konşimentoyu doğru düzenlemek ödevine sahiptir ve aksi takdirde kendisini bekleyecek kimi sorumluluklar vardır.

Bill of Lading has a special place amongst various other documents used in carriage of goods by sea due to its nature as a negotiable instrument that represents the said goods. Bill of Lading issuance is not compulsory unless requested, however there rarely is a carriage performed without it. This is because the goods can only be sold to other parties while being carried on board by means of Bill of Lading and also it being necessary for payment methods like letter of credit or cash against documents. Such importance also suggest the need for accurate issuance of the Bills of Lading. It is therefore the carrier's duty to ensure the Bill of Lading is issued in accordance with the facts, otherwise the carrier will be liable for the losses related thereto.
