Siber suçlar üzerine bir araştırma

Abstract

Günümüzde internetin yoğun olarak kullanılması ve sosyal ilişkilerin sanalortamlara taşınması ile birlikte sosyal bir olgu olan suç da sanal ortama taşınmayabaşlamış, bu gelişme sonucunda siber suç kavramı ortaya çıkmıştır. Her geçen günartan siber suç sayısı ile birlikte bu suçlardan mağdur olanların sayıları da artmaktadır.Bu bağlamda çalışmanın kavramsal çerçevesinde öncelikle siber suç kavramı üzerindedurulmuş, bu suçların kanunlarda bulduğu karşılıklar araştırılmış. Kuramsalçerçevesinde klasik okulun suçu açıklamada kendisinden önceki teorilere göre farklıbir bakış açısı getiren rutin aktiviteler teorisi incelenmiş. Uygulama kısmında iseAmerika Birleşik Devletleri vatandaşları arasında suç mağduriyetinin incelenmesiiçin, Pew Research Center isimli bir kuruluşa ait verilerin analizi SPSS programı ileçözümlenmiştir. Yapılan incelemelerde siber suç mağduriyeti ile demografikdeğişkenler arasında (cinsiyet hariç) anlamlı ilişkiler tespit edilmiştir. İnternetkullanıcılarının çoğunluğunun kendilerini suçtan koruyacak tedbirler aldığı, bununlabirlikte yoğun bir şekilde rutin aktivitelerde bulunduğu görülmüştür. Rutin aktivitelerile siber suç mağduru olma arasında anlamlı ve pozitif yönde bir ilişki tespit edilmişolup rutin aktiviteler teorisinin siber suçları açıklamakta başka çalışmalarladesteklenmesi gerektiği kabul edilmekle birlikte kısmen yeterli olduğu görülmüştür.Anahtar Kelimeler: Siber Suç, Avrupa Konseyi Siber Suçlar Sözleşmesi, RutinAktiviteler Teorisi, Mağduriyet.

Nowadays, with the intense use of the Internet and the transfer of socialrelations to the virtual platforms, a social phenomenon what is crime has begun to bemoved to the virtual environment and the concept of cyber crime has emerged as aresult of this development. With the increasing number of cyber crime, the number ofvictims of these crimes is increasing too. In this context, first of all, the concept ofcyber crime has been emphasized in the conceptual framework of the study and theresponses to these crimes in the laws have been investigated. In the theoreticalframework, the classical school's theory of routine activities, which brought a differentperspective to the previous theories, was examined in explaining the crime. In theapplication part, for analyzing crime victimization among the citizens of the UnitedStates, the analysis of data belonging to an organization named Pew Research Centerwas analyzed by SPSS program. Significant relationships between cybercrime anddemographic variables (except gender) were determined. It was seen that the majorityof the Internet users took measures to protect themselves from crime, but were engagedin routine activities. A significant and positive relationship was found between routineactivities and victimization of cybercrime, and it was found that the theory of routineactivities was partially sufficient, but it should be supported by other studies to explaincybercrime.Key Words: Cyber Crime, Cyber Crimes Treaty Of Europan Council, Routine ActivitiesTheory, Victimization
