Abstract
Organize suç olgusu, son yıllarda dünya genelinin en önemli gündem maddelerindenbirisi olmuştur. Ülkemizde de, neden olduğu siyasal, ekonomik, sosyal ve güvenlik sorunlaryüzünden organize suçların toplum hayatına yönelik riskleri giderek artmaktadır.Organize suçluluktaki bu artış, bu suça karşı alınan tedbirlerin yeterli olup olmadığısorusunu sık sık gündeme getirmektedir.Çalışmada, geniş bir literatür taraması yapılmış, ayrıca organize suçluluğun yoğunolarak görüldüğü illerin organize suçlarla mücadele birimleri tarafından cevaplanananketten çıkan sonuçların değerlendirilmesi ile konu sunulmaya çalışılmıştır. Böylece,ülkemizde yeterince incelenmeyen organize suç fenomeni, kolluğun bakış açısıylairdelenmiştir.Çalışma beş ana bölümden oluşmaktadır. Birinci bölümde uygulanan anketin amacı,cevap aranan sorular ve izlenen yöntem ve kullanılan teknikler hakkında bilgilerverilmektedir. Bu bölümü takip eden ikinci, üçüncü ve dördüncü bölüm ise çalışmanınteorik çerçevesini oluşturmaktadır.İkinci bölümde, her ülkenin kendi sosyo-kültürel, politik-ekonomik koşullarındaortaya çıkan organize suç olgusu, tarihsel süreç içerisinden bakarak anlaşılmayaçalışılmıştır. Yine bu bölümde, organize suçun dışa yansıyan özellikleri ve global organizesuç aktörlerinin yasadışı faaliyetleri ele alınmıştır.Üçüncü bölümde, Türkiye'deki organize suç durumu çok yönlü olarak ele alınmıştır.Öncelikle, Türk organize suç gruplarının temel özellikleri üzerinde durulmuş ve alınanmücadele tedbirleri istatistiki veriler ışığında incelenmiştir. Dördüncü bölümde ise,organize suç faaliyetleri ile mücadeleye yönelik temel uluslar arası ve ulusal mevzuata yerverilmiştir.Beşinci ve son bölümde, uzman kolluk mensuplarına uygulanan anket çalışmasınınsonuçlarına yer verilmiştir. Organize suçla mücadele hangi yöntemlerin daha etkin olduğuve mücadelede karşılaşılan güçlük ve problemlerin neler olduğu, ankete verilen cevaplarladaha net ve kapsamlı bir şekilde ortaya konulmuş ve bu bulgulara dayalı olarak bazı çözümönerileri getirilmiştir.Anahtar Kelimeler: Organize suç, suç grubu, uzman kolluk, soruşturma, mücadele.ABSTRACTErsoy, Ömer, The Phenomenon of Organized Crime and The National Concept toCombat It, Master's Thesis, Advisor: Assoc. In our country, as a result of the social, economic andsecurity problems posed by the organized crimes, the risks to the life of society are on theincrease. This increase in the organized crime brings about the question if the measures tocontrol the organized crimes are sufficient or not.In this study, it has been made a wide literature review and the results of the surveyanswered by the counter-organized crime units of those cities in which the organized crimeincidents are relatively higher, have been analyzed. Thus, the organized criminality, whichisn't studied enough, has been subject to the examination from the standpoint of lawenforcement.The study has five main chapters. In the first chapter, the methodology and the mainquestions and targets have been identified. In the second chapter, the phenomenon oforganized crime, which develops in each country's own socio-cultural, political andeconomic conditions, has been examined in the light of the historical process. The featuresof organized crime and the global actors of the organized criminality have been discussedin this chapter as well.In the third chapter, the organized crime situation in Turkey has been examined withmulti-dimensional aspects. Especially, the basic characteristics of the Turkish criminalgroups have been discussed. In the following chapter the relevant national andinternational legislation aiming at combating organized crimes have been focused on.In the fifth and the last chapter, the results of the survey have been discussed. Theanalysis of the survey has made it possible to determine more clearly which methods aremore effective in the struggle against organized crimes and what the problems anddifficulties are encountered in tackling with these crimes.
