Uluslararası hukukta devletlerin ülkesi dışında kuvvet kullanımı: Türkiye'nin Güneş Harekâtı örneği

Abstract

Türkiye'nin PKK terör örgütü sorunu, PKK'nın kuruluş aşamasından itibaren uluslararası bir boyuta sahip olmuştur. Gerek örgütün Avrupa bağlantıları, gerekse Irak'ın kuzeyini hareket ve destek alanı olarak kullanması nedeniyle Türkiye'nin PKK ile mücadelesinin uluslararası boyutu, her zaman ön planda olmuştur.Literatürde, Türkiye'nin yapmış olduğu sınır ötesi operasyonların, BM Antlaşması çerçevesinde, özellikle 11 Eylül sonrasındaki yaklaşımlarla beraber değerlendirilerek incelendiği, geniş çaplı bir çalışmanın olmadığı görülmüştür. Bu çalışmanın, bu alandaki eksikliği de gidereceği düşünülmektedir.Bu çalışmada, Türkiye Cumhuriyeti'nin PKK ile mücadelesi kapsamında sınır ötesi operasyonu ?Güneş Harekâtı?, uluslararası terörizme karşı kuvvet kullanımı temelinde, meşru müdafaa hakkının kullanımında 11 Eylül sonrasında yaşanan gelişmeler de göz önünde tutularak, ?jus ad bellum? çerçevesinden incelenmeye çalışılmıştır.Çalışmada, uluslararası hukuk ve terörizme karşı kuvvet kullanımı kapsamında BM Antlaşması'nın 51. Maddesi temelindeki kavramsal çerçeve ve bu hakkın kullanılması için BM Antlaşması ve teamül hukukundan kaynaklanan koşullar incelenmiş, 11 Eylül sonrasında meşru müdafaa hakkının kapsamı ve uygulaması konusunda ortaya konulan görüşlere de değinilmiştir.Ayrıca, Güneş Harekâtı'nın hedefi olan PKK terör örgütünün kurulmasında rol oynayan etkenler, kuruluş yılları ve sonrasındaki belli başlı olayları ve dönemsel olarak örgütün geçirdiği dönüşüme de yer verilmiştir.Güneş harekâtı, BM Antlaşması 51. Maddesi çerçevesinde terörizme karşı meşru müdafaa hakkının kullanım koşullarının yanı sıra Harekâta devletler, uluslararası kuruluşlar ve kamuoyunun tepkileri açısından da incelenmiş ve değerlendirilmiştir.Anahtar Kelimeler: Terörizm, Meşru Müdafaa Hakkı, PKK, Sınır ötesi Operasyon, Güneş Harekâtı

The problem of PKK (as a terrorist organisation) that Republic of Turkey has encountered since its inception to this date, has always had an international dimension. As a matter of fact, the northern part of Iraq has been utilized as a base of action and support by the terrorist organization, as well as the associated networks inside the European territory, have brought the international dimension of Turkey?s counterterrorism efforts against PKK to the fore, all the way along the line.This study deals with the subject of invoking self-defense right, based on the use of power against international terrorism in the framework of ?jus ad bellum? concept, especially elaborating on Turkey?s military cross-border counterterrorism operation, the ?The Operation Sun?, levelling at PKK terrorist organization, along with a focus on the developments in the wake of September 11.The study also offers assessments on conceptual framework of terrorism, the reasons and effects of the definition problem of terrorism in the international law, the definition of `terrorist organization?, and reviews the relationship between terrorism and similar concepts.Again, in the context of international law and use of power against terrorism, the conceptual framework within the Article 51 of the UN Charter is examined and conditions stipulated in the UN Charter and customary law in order to use this right, to include different opinions, aroused in the aftermath of September 11 about the scope and practice of the right of self-defence.The study also features various factors that played role in the inception of PKK, ?which was terrorist organization main target of The Operation Sun?, its first years, subsequent major events and periodical transformations it experienced.Operation Sun and conditions for exercising the right to self defense against terrorism were studied in the framework of the Charter of the United Nations, Article 51, as well as ensuing reactions for and against the Operation, raised by states, international organizations and public opinion.Keywords: Terrorism, Right to Self Defense, PKK, Cross-border Operation, The Operation Sun.
