Aile içi şiddet, kadına yönelik şiddet ve 6284 sayılı kanun kapsamında koruyucu ve önleyici tedbirler

Abstract

Aile İçi Şiddet, Kadına Yönelik Şiddet ve 6284 sayılı Kanun KapsamındaKoruyucu ve Önleyici Tedbirler başlıklı tez çalışması aile içi şiddet ve kadına yönelikşiddet konusunda uluslararası alanda yapılan çalışmalar ile bu çalışmalar neticesindeortaya çıkan düzenlemeler ve bu düzenlemelerin iç hukukumuza yansımasınıkapsamaktadır. Çalışmada halen dünya çapında en büyük sorunlardan biri olan aile içişiddet ve kadına yönelik şiddetin tarihsel süreçte varlığı, şiddetin önlenmesi ve sonaerdirilerek etkisinin ortadan kaldırılması için uluslararası alanda verilen mücadele ve bumücadele neticesinde ülkemizde yaşanan gelişmelerle, bu gelişmelere paralel şekildehazırlanan 6284 sayılı Ailenin Korunması ve Kadına Yönelik Şiddetin Önlenmesine DairKanun ele alınmıştır. 6284 sayılı Kanun'da korunan kişiler ve bu kişilerle şiddetuygulayanlar açısından verilebilecek tedbir kararları ise ayrıntılı bir şekilde incelenmiştir.Bu kapsamda tez çalışmasının ilk bölümünde aile içi şiddet ile kadına yönelik şiddettanımlanarak, sayısal verilerle günümüzde uluslararası alanda kabul görülen şiddet türleriincelenmiştir. İkinci bölümde ise aile içi şiddete ve kadına yönelik şiddete ilişkinuluslararası ve ulusal düzenlemelerden bahsedilmiş, Birleşmiş Milletler ve AvrupaKonseyi tarafından yapılan aile içi şiddet ile kadına yönelik şiddete ilişkin çalışmalar izahedilerek, ülkemizde Anayasa ve sair mevzuat kapsamında bu konuda yapılandüzenlemelere değinilmiştir. Üçüncü bölümünde de konunun önemine binaen aile içişiddet ve kadına yönelik şiddet konusunda ülkemizde halen uygulanan 6284 sayılıKanun'dan bahsedilerek, özellikle şiddet mağdurlarının korunarak şiddetin önlenmesi vetekrarının engellenmesi için şiddet uygulayan ve şiddet mağduru açısından verilebilecektedbir kararlarından bahsedilmiştir. Çalışmanın son bölümünde 6284 sayılı Kanun'agetirilen eleştiriler açıklanmaya çalışılmış, aile içi şiddet ve kadına yönelik şiddetkonusunda öneriler sunulmuştur.Anahtar Kelimeler: Şiddet, Aile İçi Şiddet, Kadına Yönelik Şiddet, CEDAW,İstanbul Sözleşmesi, 6284 sayılı Kanun, Koruyucu ve Önleyici Tedbirler.

The thesis study titled Domestic Violence, Violence Against Women and Protectiveand Preventive Measures within the Scope of Law No. 6284 covers the studies carriedout in the international arena on domestic violence and violence against women, theregulations that emerged as a result of these studies, and the reflection of these regulationsin our domestic law. In the study, the existence of domestic violence and violence againstwomen in the historical process, which is still one of the biggest problems around theworld, the struggle in the international arena for the prevention and elimination ofviolence, and the developments in our country as a result of this struggle, and the LawNo. 6284 on the Protection of the Family and the Prevention of Violence Against Women,which was prepared in parallel with these developments, were discussed. The injunctionsthat can be taken in terms of persons protected by the Law No. 6284 and those whoperpetrate violence against these persons were examined in detail.In this context, in the first part of this thesis study, domestic violence and violenceagainst women were defined, and the types of violence accepted in the international arenawere examined with statistical data. In the second part, international and nationalregulations on domestic violence and violence against women were mentioned, thestudies on domestic violence and violence against women carried out by the UnitedNations and the Council of Europe were explained, and the regulations made in ourcountry within the scope of the Constitution and other legislation were discussed. Due tothe importance of the subject, in the third part the Law No. 6284, which is still appliedin our country concerning domestic violence and violence against women, wasmentioned, and the injunctions that can be taken for the perpetrators of violence and thevictims of violence were discussed, especially in order to prevent violence by protectingthe victims of violence and to prevent its repetition. In the last part of the study, thecriticisms brought to the Law No. 6284 were tried to be explained, and suggestions werepresented on domestic violence and violence against women.Keywords: Violence, Domestic Violence, Violence Against Women, CEDAW,İstanbul Convention, Law No.6284, Protective and Preventive Measures.
