Hükümet sistemlerinin analizi: Yeni bir Başkanlık modeli olarak Cumhurbaşkanlığı Hükümet Sistemi

Abstract

Siyasal yapının temelini oluşturan hükümet sistemleri, siyasal alanda en çok tartışılan konulardan birisi haline gelmiştir. Türkiye'nin de dahil olduğu dünyanın birçok ülkesinde istikrarı sağlamadığı düşünülen hükümet sistemleri, ülkeleri değişiklik yapmaya itmiştir. Ülkemizin uluslararası standartlarda demokratik bir hukuk devleti olması amacıyla, istikrarlı hükümetleri hedefleyerek yaşanan değişim ve yenilikleri her aşamada geliştirilerek Türkiye sistemine dahil etme çalışmaları ve çabaları aktarılmaya çalışılmıştır. Çalışmanın amacı Türkiye'de uygulanan hükümet sistemlerini dönemsel olarak incelemek ve cumhurbaşkanlığı hükümet sistemi ile analizi tamamlamaktır. Türkiye'de tecrübe edilen hükümet sistemlerinin temellendirildikleri dayanakları, uygulama yöntemleri, avantajlı ve dezavantajlı yönleri uygulama sırasında karşılaşılan sıkıntılar ve bu sıkıntılara karşı geliştirilen çözümler detaylı olarak ele alınmıştır. Teorik olarak kuvvetler ayrılığı ele alınarak hükümet sistemleri ile ilişkisi ortaya konulmuştur. Farklı hükümet sistemlerinin sınıflandırması yapılmış ve temel ayırt edici özellikleri belirtilmiştir. Başkanlık sistemi, yarı başkanlık sistemi ve parlamenter sistem güçlü ve zayıf yönleriyle kaleme alınmıştır. Türkiye'de yaşanan hükümet sistemleri tarihsel akışa göre detaylandırılıp dönemsel koşullar göz önüne alınarak açıklanmıştır. Cumhurbaşkanlığı hükümet sistemine giden arayış irdelenmiş ve sistem açıklanmaya çalışılmıştır. Cumhurbaşkanlığı hükümet sisteminin özellikleri, yapılan değişiklikler, kontrol ve denge mekanizmalarına dikkat çekilmeye çalışılmıştır.

Government systems which form the basis of the political structure have become one of the most discussed issues in the political field. Government systems which are thought to not provide stability in many countries of the world, including Turkey, have obligated countries to make changes.In order for our country to be a democratic state of law at international standards, it has been tried to convey the efforts and efforts to include the changes and innovations in the Turkish system by developing them at every stage by aiming stable governments.The aim of the study is to periodically examine the government systems implemented in Turkey and to complete the analysis with the presidential government system.The foundations of the government systems experienced in Turkey, the application methods, the advantageous and disadvantageous aspects, the problems encountered during the implementation and the solutions developed against these problems are discussed in detail.Theoretically the separation of powers has been discussed and its relationship with government systems has been revealed. Different government systems have been classified and their main distinguishing features have been stated. The presidential system, the semi-presidential system and the parliamentary system are written with their strengths and weaknesses. The government systems in Turkey are explained in detail according to the historical flow and by considering the periodic conditions. The search for the presidential government system has been examined and the system has been tried to be explained. It has been tried to draw attention to the features of the presidential government system, the changes made, and the check and balance mechanisms.
