Abstract

Kıssaların Fıkhı- Hz. Salih Kıssası Örneği-? adlı bu tez, Kur'andaki kıssa ayetlerini fıkhi/hukuki bakımdan ele almaktadır.Kur'an-ı Kerim farklı konular içermektedir. Bu konular arasında yer alan kıssalar, geçmiş, şimdiki zaman, gelecek hakkında insanların karar vermesine yardımcı olur.Kıssalar, hem geçmiş zaman kesitlerinde gerçekleşmiş olayları hem de insanoğlunun ortaya koymuş olduğu davranışları ve bunların sonuçlarını ifade eder. Kıssalar Kur'an-ı Kerim'de çok önemli yer tutmaktadır. Kıssaların anlatılış amacı, salt tarihi bilgi vermek/ olayları hikâye etmek değildir. Asıl amaç, muhatapları murad-ı ilahi doğrultusunda yönlendirmektir. İslam hukukçuları Kur'an'ın önemli bölümünü dolduran kıssalardan yararlanma cihetine gitmişler ve kimi kuralları kıssalara istinad ettirmişlerdir.Bilindiği gibi İslam fıkhının menbaı/kaynağı Kur'an-ı Kerimdir. Kur'an- ı kerim salt akide kitabı değildir. Hayatın her alanını kapsayıcı mesajlar içeren bir kitaptır. İçerdiği mesajların bir kısmı gerek bireysel, gerek toplumsal hayatı tanzim etmeye yöneliktir. Kur'an'da Mesajların iletimi doğrudan olduğu gibi, kıssalar vasıtasıyla örnek olay/kıssa yöntemiyle verilmiştir. Zira kıssa üslubu en etkili anlatım yöntemlerinden birisidir.Kıssalar yakından incelendiğinde, kıssalarla biz muhataplara bir tarih perspektifi ve tarih bilinci verilmek istendiği rahatlıkla görülecektir. Kıssaların fıkhi/hukuki yönünün açığa çıkarıldığı pek söylenemez. Bu çalışmada kıssaları, barındırdığına inandığımız fıkhi yönlerini ortaya koymaya ve kıssaları aktüel hale getirmeye çalıştık. Kur'an geçmiş dönemlerin araştırılıp elde edilecek sonuçlar hususuna çokça önem vermektedir. Hz Salih kavminin helak süreci, toplumların ilerleme ve gerileme nedenlerini ortaya koymada kapsayıcı bir örnektir. Kıssaların araştırılması neticesinde elde edilecek verilerle toplum kendisini test etmeli, bulunduğu halin tesbitini yaparak gelecek perspektifini oluşturmak için çıkarsamada bulunmalıdır.

This thesis handle a wor published under the title ?Law based on Tales- Example of Hz. Salih, a muslim dignity?and elaborates from juridical point of view some verses of Koran transmitting tales.The Holy Qur?an comprises of different topics. Among these topics are some stories that help people to make decision about their past, present and future.Tales represants events happened in different periods of the human story, as well as the behaviour and reactions of human beings including the moral to be taken face these events.Tales makes an important part of the holy Koran. Their presence in this Holy book does not mean only a way to give knowledge and information on the historical past and the happenings during his history. The main purpose is to direct the neaders towards the wishes of the of the almighty God.Lawyers of the Muslim world and consequently the muslim jurisprudence take benefit from these talesand make reference to them in some İslamic ode of laws.The main source of İslamic law is Koran and Koran is not only a gathering of principles and/or articles of İslamicfaith or conveictions. Koran is a divin book comrising messages aim to install and order to the private and social life. These messages are in general transmitted directly as well as indirectly through the tales like cases to take moral. İt is well known that is metod of tales is one of the most effective way for teaching.İf one look more causally to the tales it is easy to understand that the main aim of these tales is to gie an historical perpective to the people. Although it is not easy to say that tales explicide the juridical aspects of the events.İn this study we tired to give more light to the juridical inside of the tales and actualise theme face to present daily life conditions of ours.Koran give an important imfasis to the studies of historical events and to the moral to be taken from them. The perishing process of the family or tribe Hz. Salih is a very good and comprising example to see the different reasons of development and eurichement as well as degradation and complete desturiction and complete destruction of a society.The analysing of the tale of Semud will give ground for testing the actual sitration of a social group as wellw as a firm backround for evaluating alternate perspective for their future life.
