Hanefi mezhebine göre uygulama açısından ibadet konularındaki içtihatlar

Abstract

ULUDAĞ ÜNİVERSİTESİ SOSYAL BİLİMLER ENSTİTÜSÜTEMEL İSLAM BİLİMLERİ ANABİLİM DALI İSLAM HUKUKU BİLİM DALIHANEFÃ MEZHEBİNE GÖRE UYGULAMA AÇISINDANİBADET KONULARINDAKİ İÇTİHATLARMehmet ÖZKAN(Doktora Tezi)ÖZETİslâm hukukunun temel konularından biri de ibadetlerdir. Kişi ile Allah arasındakiilişkileri düzenleyen ibadetler, tarihi süreçte genellikle içtihat alanı dışında tutulmuştur.İbadetlerin taabbüdû olmaları, onların içtihat alanı dışında tutulmalarını sağlayan en önemliunsur olarak görülmüştür.İnsan hayatında önemli yer işgal eden ibadetlerin asıllarında (özünde) içtihadınolmayacağı açıktır. Fakat zamanın ve şartların değişmesiyle uygulama noktasında birtakımiçtihatların olduğu ve olabileceği muhakkaktır. Prayers, which organizerelationship between God and man, were kept out of interpretation during historical process.the basic reason fort this is that Prayer are related to worship.It is certain that some interpretations would take place with the advent of time andconditions. Because, with the advent of time and conditions, some arrangements andorganizations, while practising prayers, would help man solving problems and difficulties. Weused the term ?interpretation? in the sense of ?to solve man?s problems?.We started, in this dissertation, with the explanation of prayers, interpretation andHanafid Jurisprudence. İn the seconde chapter, examples from el-Asl, el-Mebsut, Fethu?l-Kadûr,Bedâiu?s-Sanâi? and Reddu?l-Muhtar were stadied and we also tried to find out the nature of theconditons which produced thise interpretations (ictihads).In conclusion, we found that many interpretations had been done, despite beingopposed to the nature of prayers, just to facilitate and to solve man?s problems.COUNSELLOR: Prof. Dr. Y.
