Genel boşanma sebebi olarak evlilik birliğinin temelinden sarsılması

Abstract

Bu çalışmanın konusu, genel boşanma sebebi olarak evlilik birliğinin temelinden sarsılması kavramının açıklanması, kavramın içeriğinin belirlenmesinde dikkat edilecek hususlar, diğer boşanma sebeplerinden farkları, kusur ilkesinin bu boşanma sebebine etkisi, bu davalarda uygulanacak usul kuralları ve Yargıtay uygulamasının neler olduğudur. Bu çalışma giriş, dört bölüm ve sonuç kısmından oluşmaktadır.Giriş bölümünde; genel olarak aile ve boşanma kavramları, birinci bölümde; boşanma hukukunda benimsenen sistemler, boşanmanın dayandığı temel ilkeler ve Türk Hukukunda özel boşanma sebepleri, ikinci bölümde; boşanma nedeni olarak evlilik birliğinin temelinden sarsılması, üçüncü bölümde; yasal karineler ve dördüncü bölümde ise, usul ilkeleri ve uygulamadaki sorunlar incelenmiştir.Anahtar Sözcükler: Boşanma, Evlilik Birliğinin Temelinden Sarsılması

The objective of this study is to define the serious undermining of the marriage union which is declared as the basis for dissolution of marriage as well as the issues to be considered during specifying the content of this concept, its difference from other divorce bases, the effects of the fault principle in this divorce basis, the procedural rules which shall be applied in these law suits and the details of Supreme Court of Appeal decrees on this law suit type.Family and divorce concepts are generally mentioned in the introduction part of this paper. In the first part, the systems that are adopted in divorce law, the basic principles which divorce refers to and the special bases for divorce in Turkish Law are mentioned. In the second part, the dissolution of marriage due to serious undermining of the marriage union and in the third part; the legal dates; and in the fourth part; the procedural principles and the problems encountered during its application are mentioned.Key Words: Divorce, Divorce due to serious undermining of marriage union.
