1888?1889 yıllarına ait Samsun Şer`iyye Sicili`nde yer alan belgelerin tahlili

Abstract

Bu çalışmayla 19. yüzyılın son döneminde Samsun bölgesinin dini, sosyal, ekonomik ve kültürel açıdan durumunun tespitine katkıda bulunmayı hedefledik. Samsun'la ilgili kırk üç adet şer'iyye sicil defteri bulunmaktadır. Bu defterlerden on üçü ile ilgili çalışma yapılmıştır. Diğerleri ise henüz çalışılmamıştır. Yaptığımız bu çalışmayla hem Samsun'un tarihine katkıda bulunduk hem de bu şer'iyye sicillerinden birini transkribe ederek ilim dünyasına kazandırdık.Çalışma 1782 numaralı ve 1888-1889 tarihlerini içeren Samsun Şer'i Mahkemesine ait şer'iyye sicil defterinin tahlilidir. Tez, giriş hariç iki bölümden oluşmaktadır. Giriş kısmında, araştırmanın problem ve önemi, veri toplama araçları, araştırmanın sınırlılıkları ile kullanılan yöntemler hakkında bilgi verilmiştir.Birinci bölümde şer'iyye sicillerinin tanımı ve Samsun mahkemelerinde tutulan şer'iyye sicil defterleri ve bunlar üzerinde günümüze kadar yapılan çalışmalar belirtildikten sonra, 1782 numaralı Samsun şer'iyye sicil defterinde geçen kayıtlardan yola çıkarak, Samsun'un 19. yüzyıl sonlarındaki sosyal, kültürel, ekonomik ve idari yönlerden değerlendirmesi yapılmıştır.Çalışmanın ikinci bölümünde asıl metnin latin harflerine traskripsiyonu yapılmıştır. Transkripsiyon yapılırken kayıt başlarında içerikle ilgili kısa özet verilmiştir. Sonuç kısmında incelediğimiz şer'iyye sicil defterinden çıkarılan sonuçlar kısaca belirtilmiştir.İncelediğimiz 1782 numaralı defterde iki yüz elli bir adet kayıt bulunmaktadır. Kayıtlar vekil, kefil, vasi ve nafaka tayini; alacak verecek davası, tereke taksimi, kamu görevlisi tayini ve vakıflarlarla ilgili hükümlerden oluşmaktadır. Tanzimat fermanı sonrası, Osmanlı hukukunda yapılan yenilikler sonucunda şer'i mahkemelerin görev alanları daraltılmıştı. Bu sebeple defterimizde aile hukuku ile ilgili kayıtlar bulunmaktadır. Cezai konularla ilgili kayıt bulunmamaktadır.Çalışma 1888-1889 yıllarını ve o yıllarda mahkemeye intikal eden olayları kapsamaktadır. Kayıtlar toplumun tamamını kapsayacak durumda değildir. In this study, we aimed to make a contribution to the determination of the religious, social, economical and cultural situation in Samsun region at the end of the 19th century. There are 43 religious law documents related to Samsun. There have been 13 studies on these documents. However, there have not been any studies on the others, yet. On behalf of this study, we not only contributed to the history of Samsun but transcribing the law documents to the field.The research includes the Religious Law Documents of Samsun from the period 1888-1889 and the documents numbering 1782. The thesis includes two sections, aside from the introduction. In the introduction part, research problems, significance of the research, limitations of the study and research methodology are given.In the first section of the study, the definition of Religious Law Documents and the Religious Law Documents which were recorded in Samsun are mentioned. Regarding the registers done on the Religious Law Documents of number 1782, a detailed evaluation of Samsun?s social, cultural, economic and administrative situation is presented.In the second section of the study, the documents have been transcribed into the Latin alphabet. Within the transcription, a short summary of the context is given at the beginning of each register. In the conclusion part, the results that have been concluded from the registers are listed.There are 251 registers in the documents numbered 1782. The registers are composed of terms on attorney, surety, tutor, alimony, owings and receivables, winding f estate, assigning public officials, and charities. The duties of Religious Law Courts were limited in the time of ?The Receipt of Gülhane?. For this reason there are registration documents on family law, yet there are no registration documents on criminal law.The study includes records documents kept in law courts in Samsun from the period 1888-1889. Thus, results gathered from the study cannot be generalized to all the people living at that time; as a result a general judgment regarding all people cannot be concluded.Key Words: Samsun Religious Law Documents, Muslim Judge of Samsun, Samsun History, Canik Subdivision, Register Books of Religious Court.
