Uyuşturucu veya uyarıcı madde kullanılmasını kolaylaştırma ve özendirme suçları (TCK M. 190)

Abstract

5237 sayılı TCK'nın 190. maddesi ile `Uyuşturucu veya uyarıcı madde kullanılmasını kolaylaştırma` ve `Uyuşturucu veya uyarıcı madde kullanılmasını özendirme` suçları olmak üzere iki farklı suç tipi ihdas edilmiştir. Ancak uyuşturucu veya uyarıcı maddelere ilişkin olarak daha çok TCK m. 188'de ve TCK m. 191'de yer alan uyuşturucu madde imal ve ticareti ve uyuşturucu madde kullanma suçları uygulama alanı bulmaktadır ve bu suçlar öğretide sıklıkla çalışılmaktadır.Sosyal medya ve İnternet'in yaygınlaşmasıyla özellikle TCK m. 190/2'de yer alan uyuşturucu veya uyarıcı madde kullanılmasını özendirme suçunun daha sık gündeme gelmesinin bir sonucu olarak TCK m. 190 düzenlemesindeki eksikler ve bu suçların uygulanmasındaki sıkıntılar daha net bir şekilde ortaya çıkmıştır. Bu doğrultuda, çalışma konusu olarak TCK m. 190'da yer alan suçlar tercih edilmiştir.Çalışmamızda TCK m. 190'da yer alan uyuşturucu veya uyarıcı madde kullanılmasını kolaylaştırma ve özendirme suçlarının unsurları, konuya ilişkin yargı kararlarına yer vermek suretiyle incelenmiştir. In the article of 190 of Turkish Penal Code numbered 5237, two types of crimes headed `Facilitating the use of narcotics or psychotropic substances` and `Encouragement the use of narcotics or psychotropic substances` have been specified. However, in practice, regarding narcotics and psychotropic substances, the articles of 188 (crime of the production and trading of drugs) and the article of 191 (crime of use of drugs) of Turkish Penal Code are implemented by penal courts and these crimes frequently studied in doctrine.The dissemination of usage of social media and Internet brought the crime of encouragement the use of narcotics or psychotropic substances as specified in the article of 190/2 of Turkish Penal Code to the agenda more frequently. As a result of this issue, deficiencies of the article 190 of Turkish Penal Code regulation and problems faced in the implementation of these crimes revealed more clearly. In accordance, the crimes specified in the article of 190 of Turkish Penal Code have been preferred.In our study, the elements of the crimes of facilitating and encouragement the use of narcotics or psychotropic substances stated in article of 190 of Turkish Penal Code have been examined by mentioning jurisdictional decisions relating with the subject.
