Adalet ilkelerinin Osmanlıdan günümüze Türk Hukukunda görünümü

Abstract

Modernizm ile beraber gelişen hukuki pozitivizm akımı doğrultusunda hukuk teorilerinin içinde ahlak öncüllü ilkeler ve adalet kavramı önemini yitirmiştir. Katı hukuki pozitivizimin hukuk aleminde yarattığı bu boşluk sonucunda kanunlar ve hukuk sistemleri adaleti sağlamaktan uzaklaşmıştır. Bunun sonucunda günümüzde farklı teorilere bakıldığında, etik değeri temel alan ahlak öncüllü ilkelerin tekrar önem kazandığı görülmektedir. Söz konusu teoriler hem hukuk yapımında hem de yargılama aşamasında ilkelerin önemine vurgu yapmışlardır. Bu bağlamda ilkeler, kanunu yorumlarken ve yargılama sırasında adaletin gerçekleşmesi için araç niteliğindedir. Günümüzde AİHM'in uygulamasına ve Anglo Sakson hukuk geleneğine bakıldığında bu anlayışın hakim olduğu görülmektedir. Bu anlayış ise geleneksel Türk hukuk zihniyeti – özellikle de Osmanlı hukuk sistemi – ile paralellikler arz etmektedir. Osmanlı devleti adaletle hükmetme geleneğini yansıtırken, hukuk sistemi de adalet kavramı üzerine şekillenmiştir. Bu bağlamda hem kuralların yorumlanmasında hem de yargılama aşamasında temel değer olan adaleti sağlamak adına günümüzdeki hukuk kuramlarında ve insan haklarını koruyacak belgelerde yer alan ilkelere benzer ilkeler geleneksel Türk hukuk zihniyetinde kendine yer bulmuştur.

Morally grounded principles and the concept of justice have lost its significance within the legal theories in line with legal positivism, which had developed with modernism. Statutes and legal systems have failed to maintain justice as a result of the gap created by the rigid legal positivism in the legal universe. This follows from that, when taking into consideration in different contemporary theories, one can see that morally grounded principles that are based on the ethical value has gained a major significance once again. These theories emphasize the importance of principles within the both process of law-making and legal reasoning. In this regard, the principles became instruments of maintaining justice during the statutory interpretation and legal reasoning process. Contemporarily, a legal thought based upon this approach is dominant within ECtHR implementation and Common Law Systems also, this understanding bears a resemblance with traditional Turkish legal thought –especially in Ottoman legal system-. Whereas Ottoman Empire practices the custom of ruling with justice, its legal system has also built upon the concept of justice. Concordantly, the principles which are similar to the ones that formulated in the contemporary legal theories and the documents for human rights protection, can be traced back into traditional Turkish legal thought in order to maintain justice which is the basic value in both the statutory interpretation and legal reasoning.
