Abstract
Bu çalışma, İslam Ceza Hukukunda suç ve ceza arasındaki dengeyi başta Kur'an ve Sünnet olmak üzere diğer deliller ışığında ele almaktadır. Kur'an ve Sünnette had suçları bağlamında ayrıntılarıyla zikredilen zina, zina iftirası, hırsızlık, içki içme, yol kesme ve İslam dininden dönme ve kurulu düzene başkaldırı cezaları; adam öldürme ve yaralama suçları bağlamında zikredilen kısas cezaları; kısas cezalarının belli sebeplerle uygulanamayıp onun yerine geçen ekonomik boyut bağlamında zikredilen mali cezalar; daha çok ibadet ve ceza bağlamında ele alınan keffaret cezaları ve cezaî takdir hakkının yetkili otoriteye bırakılması bağlamında ta'zir cezaları, suç ve ceza arasındaki denge açısından detaylıca ele alınmakta ve mezheplerdeki gerekçeli görüşler ve cezanın genel prensipleriyle karşılaştırması yapılmaktadır. Ayrıca denge anlamına gelen terimler ve hukuki dayanağı da araştırmada ihmal edilmemektedir. Keza önceki toplumlarla ve modern hukukla da mukayese yapılabilmesi için suç-ceza dengesinin tarihi arka planı ve konuyla ilgili kavram ve karşılaştırmalara da değinilmiştir.Anahtar Kelimeler; Suç, Ceza, Denge, Kur'an, Sünnet, Suç-Ceza Dengesi This study addresses the balance between crime and punishment in Islamic Criminal Law in the light of other evidence including the Quran and Sunnah in particular. Adultery, casting a slur on chastity, theft, wine drinking, road cutting, renunciation of the religion of Islam and disobedience to the established order punishments mentioned thoroughly in the context of had crimes in Quran and Sunnah; retaliation penalties mentioned in the context of murder and injurycrime; financial penalties supplanting by retaliation penalties that are not imposed for obvious reasons mentioned in the context of the economic dimension; expiatory punishments discussed mostly in the context of worship and punishment, and ta'zir punishments in the context of the criminal discretion being left to the competent authority are discussed in detail with regard to the balance between crime and punishment and reasoned opinions and their comparison with the general principles of punishment is made. Besides, the terms meaning balance and its legal basis are not neglected in the study. Also, the historical background of the crime-punishment balance and the concepts and comparisons relevant are discussed as well in order to make a comparison with previous societies and modern law.Keywords: Crime, Punishment, Balance, Quran, Sunnah, Crime-Punishment Balanc
