Abstract
İslam Hukuku Metodolojisi'nde, ilk dönemden itibaren Mütekellimîn ve Fukahâ usûlcüleri, lafzın manaya delâlet yolları ile istidlâl etmekte farklı görüşler ileri sürmüşledir. Zaman zaman aynı delillerle farklı hükümler çıkarmışlar veya başka farklı deliller yardımıyla aynı hükümleri elde etmişlerdir. Bu çalışmayı yapmamızdaki asıl amacımız, Mütekellimîn ve Fukahâ metodunu benimseyen usûlcülerin, lafzın manaya delâletiyle ilgili görüşlerini tek tek ele alıp, daha sonra iki metod arasındaki farkları ortaya koymaktır.Çalışmamızda öncelikle Mütekellim ve Fukahâ metodunun özelliklerine, farklarına, önde gelen âlimlerine ve ilgili eserlerine değinilmektedir. Daha sonra istidlâl ve delâlet kavramları ile delâletin dilsel ve dilsel olmayan kısımları hakkında bilgi verilmektedir. Sonrasında ise lafzın manaya delâlet yollarının bu iki metoda göre taksimi, tanımları, delil olabilmesi için gerekli olan şartları ve bu metodları benimseyen usûlcülerin fikirlerini ispatlamak için gösterdikleri örnekler ayrı ayrı incelenmektedir. In Islamic Law Methodology, from the earliest times, the Mutakallimun and the Fukahâ Methodists have put forward different opinions in terms of the ways of implication of manuscripts. From time to time they have made different provisions with the same evidence or have obtained the same provisions with the help of different arguments. Our main purpose in this work is to individualize the opinions of the followers who adopt Mutakallim and Fukahâ methods on the conclusion of the implications of manuscripts one by one, and then to reveal the differences between the two methods.In our work, first of all the features, differences, and the leading scholars of the Mutakallim and Fukahâ Methods are mentioned. Then, besides the concepts of implication and inference, the separation of inference into linguistic and non-linguistic parts are mentioned. Later the classification of the ways to derive implications from manuscripts according to these two methods, their definitions, the necessary conditions to be accepted as evidence and the examples the scholars show to prove their ideas are discussed separately.
