Ulusal Kurtuluş Savaşı Dönemi`nde anayasal gelişmeler ve 1921 Anayasası

Abstract

Birinci Dünya Savaşı'nın sonu ve Mondros Bırakışması sonrasında yaşanan gelişmeler, Osmanlı İmparatorluğu'nda bir devlet ve iktidar sorunu ortaya çıkarmıştır. Anadolu'da yaşayan halk bu sorunu, imparatorluğun diğer unsurlarının daha önce yaptığı gibi, bu coğrafyada bir ulus devlet kurarak aşmıştır. Ulusal Kurtuluş Savaşı tarihi, aynı zamanda yeni bir devlet ve yeni bir hukuk yaratma tarihidir. Bu yeni devletin temellerinin atılması, anayasal nitelikli belgelerle gerçekleştirilmiştir. `Osmanlı'dan Türkiye'ye uzanış süreci` olarak adlandırabileceğimiz bu sürecin değişik aşamalarında ortaya çıkan değişik metinlerde, varılan noktayı izlemek olanaklıdır. Metinler açısmdan bakıldığında bu sürecin doruk noktası, Halkçılık İzlencesi ve 1921 Anayasası 'dır. Halkçılık İzlencesi ve 1921 Anayasası, sürecin anayasal ilke ve kavramlanmn olgunlaştırılıp ve topluca ortaya konduğu metinlerdir. Bu çalışmada, Ulusal Kurtuluş Savaşı döneminin başlıca siyasal gelişmeleri zamandizinsel bir sıra içinde ele alınmış, anayasal gelişmeler ve belgeler bu zamandizinsel çerçeve içine oturtulmuştur. Dönemin başlıca anayasal ilkelerinin toplandığı bir metin olan 1921 Anayasası, bu çerçeve içinde anlamlandırılmaya çalışılmıştır. 220

The end of the World War I and the Armistace of Mudros caused a problem of state and a problem of power in the Ottoman Empire. The people of Anatolia solved this problem by establishing a nation state like the other peoples of the empire had done before. The history of the Turkish National Independence War, is the history of creating a new state and a new law as well. Founding the basis of this new state was done by constitutional documents. It is possible to examine the stages of the National Independence War by the help of the different documents which came out in the different stages of the war. The Program of Populism and the Constitution of 1921, which show the basic constitutional principles and terms, are the most important documents of this process. In this study, the main political developments of the National Independence War are examined in a chronological order and the constitutional developments are tried to be set in this frame. 221
