Avrupa insan hakları sözleşmesi ışığında din özgürlüğü

Abstract

İnsanlık tarihinin baslangıcından itibaren din toplumda bireyler arasıiliskiler ve devlet birey arasındaki iliskiler açısından önemli bir dinamik olmustur.Günümüzde de din bu önemli islevini korumakta, din özgürlügünün kapsamı vesınırları güncel olarak tartısılmaktadır. Türkiye'de genis yankı bulan bu tartısmalaraçısından hukuki zeminde en önemli referans noktasını Türkiye'ninde taraf olduguAvrupa insan Hakları Sözlesmesi'nin (A.İ.H.S.) 9. maddesi ve Sözlesmeorganlarının bu maddeye iliskin içtihadı olusturmaktadır. Bu çalısma ile amacımızdin özgürlügü konusunda A.İ.H.S. ve Sözlesme organlarının belirledigi standartlarıortaya koymak olacaktır.Anahtar kelimeler : Avrupa İnsan Hakları Sözlesmesi, Din, Özgürlük

Since the beginning of the history of humanity, religion has been an importantdynamic in the society for the relationship between individuals and for therelationship between the state and individuals. Today religion guards this importantfunction and the scope and limits of the freedom of religion continue to bediscussed. For the ongoing debates that have found great echo in Turkey, article 9of the European Convention on Human Rights (E.C.H.R.), which Turkey is a partyto, and the jurisprudence of the organs of the Convention concerning this articleconstitutes the reference point. The aim of this work is to demonstrate the standardsconcerning the freedom of religion put forward by the E.C.H.R. and the organs ofthe Convention.Keywords :European Convention on Human Rights, Freedom of Religion,Freedom,
