Abstract
Kazakistan'ın 1995 Anayasası, insan hak ve hürriyetlerini tanımış ve bu değerlerin devletçe güvence altına alınacağına dair teminatlar getirmiş. Sovyetler Birliği dönemindeki komünist ideolojinin her şeyden üstün ve kutsal bir değer olarak toplum ve devlet hayatına hakimiyetinin uzun yıllar boyunca sürmesi, insan haklarının korunmasını ve bu mevzudaki önemli bir meslek olan avukatlık hizmetinin de ehemmiyetini ve değerini kaybetmesine neden olmuştu. Sovyetler Birliği döneminde avukatlık mesleğinin çok önemsiz bir mevkide bulunduğu açık bir gerçektir. Fakat Kazakistan Cumhuriyeti'nin bağımsızlığını almasıyla birlikte birtakım demokratik ve liberal reformlar kökten yürütülmeye başladı. 1995 Anayasası avukatlık mesleğine dair düzenlemelerin ilk ipuçlarını vermekteydi. Ancak, 1997 yılında kabul edilen Kazakistan Cumhuriyeti'ndeki `Avukatlık Kanunu` bu alandaki esas ilkeleri ve düzenlemeleri beraberinde getirdi. Bu Kanunun kabul edilmesiyle birlikte avukatlık hizmeti, prensip ve içerik itibariyle tamamen değişikliğe uğradı. Zira, önceki düzenlemede toplumun ve devletin sosyo- ekonomik yapısı tamamen farklı idi. Özel mülkiyetin oluşması, gelişen pazar ekonomisi şartlarında avukatlık hizmeti daha geniş ve kapsamlı bir şekil aldı. Sovyetler Birliği döneminde avukatlık hizmeti % 90 civarında ceza işleriyle alâkalı idi. Oysa, yeni toplumsal gelişmeler neticesinde avukatlık bir tek ceza işleri çerçevesinen sıyrılıp, medenî ve idarî alanları da kapsamına almaya başladı. Kazakistan Cumhuriyeti'nde insan hak ve hürriyetlerinin mahkemede savunulması ve bilgili hukukî yardımın alınması devlet tarafından teminat altına alınmıştır. Avukatlık hizmeti, ceza işlerinde savunmada, medenî, idarî ve ceza işlerinde temsil etmede ve insan hak ve hürriyetlerini ve hukukî çıkarlarını veya tüzel kişilerin hukukî çıkarlarını savunmada, diğer hukukî yardımların yapılmasında avukatların faaliyetlerinin tümüdür. 1995 Constitution of Kazakhstan acquainted with the rights and freedom of people, and brought a guarantee concerning that these values would be in assurance by state. In this period of Soviet Union communist ideology had a superior power and value on society and on the life of this state. Lasting of this dominations for a long time, defending the rights of people, and all of these factors were the reason of losing the value and importance of the function of advocacy, which as the most important profession on this topic. It is true that in the period of Soviet Union the profession `advocacy` was in a very unimportant condition. But after getting the independence of the Republic of Kazakhstan, several democratic and liberal reforms started to execute from the root. 1995 Constitution was giving its first clue of disposition related to the profession of advocacy. However, `Advocacy Law` of Republic of Kazakhstan, which was accepted in 1 997, brought basic principles in this area and arrangements together. With the acceptance of this Law, function of advocacy, essentially principles and content completely suffered a change. Because, in the proceeding arrangement the socio- economic structure of society and state was completely different. The function of advocacy, in formation of private possession and in the condition of economy of developed market takes wider and broad shape. In the period of Soviet Union the function of advocacy was about % 90 concerned with criminal cases. Whereas, in the result of new social development the advocacy, skinned from the frame of only criminal case, and began to broad its functions to civil and administrative areas. In Republic of Kazakhstan, defending of the rights and freedom in the court and taking the professional legal aid was taken under the guarantee. The function of advocacy is to give a legal aid in order to protect the rights and freedom of people and legal profits of judicial persons in criminal, civil and administrative cases and represent itself as a defender of law.
