Medenî Usûl Hukukunda dava dilekçesinin içeriği ve eksikliklerin giderilmesi

Abstract

Medenî usûl hukukunda dava dilekçesi, yargılama sürecini başlatmakta ve davanın sınırlarını çizmektedir. Davacı, dava dilekçesini kanunun aradığı şartlara uygun olarak hazırlamalıdır. Davacı özensiz, eksik hazırlanmış bir dava dilekçesi ile hakkını elde edemez. Dava dilekçesinde özellikle vakıalar ve deliller eksiksiz gösterilmeli ve somutlaştırılmalıdır. Talep sonucu dava türüne göre açık bir şekilde ifade edilmelidir. Hukuk uygulamasında, dava dilekçesi Hukuk Muhakemeleri Kanununa uygun şekilde hazırlanmalıdır.Dava dilekçesinde eksiklik bulunması hâlinde ne yapılması gerektiği Hukuk Muhakemeleri Kanununda düzenlenmiştir. Eğer davacı ile davalının adı, soyadı ve adresleri, davacının Türkiye Cumhuriyeti kimlik numarası, tarafların temsilcilerinin adı, soyadı ve adresleri, talep sonucu ve imza eksikse mahkeme davacıya eksikliği tamamlaması için davacıya bir haftalık kesin süre verir. Dava dilekçesindeki diğer eksikliklerin tamamlanmasında ise her eksiklik türü ayrı ayrı değerlendirilmelidir.

In cıvıl procedure law, the petition initiates the proceedings and draws the case's boundaries. The plaintiff must prepare the case according to the law. The plaintiff can not obtain his / her right with a sloppy, incomplete case petition. In particular the facts and the evidences must be fully shown and embodied. The demand must be expressed clearly in relation to the case. In the application of the law, the petition must be prepared in accordance with the Law on Civil Procedure.What is to be done if there is a deficiency in the petition is regulated in the Law on Civil Procedure. If the name, surname and adress of the plaintiff and the defendant, Republic of Turkey identity number of the plaintiff, names, surnames and adressesof the represantatives of the parties, demand and sıgnature is missing, the court will give the plaintiff a peremptory term of one week to complete the deficiency. In the case of completing other deficiencies in the petition, each deficiency must be evaluated seperately.
