16 numaralı Konya şer`iye sicili (1083 / 1672-1673) değerlendirme ve transkripsiyon

Abstract

Sicil, Osmanlı Devleti'nin son yıllarına kadar devam eden şer'î mahkemelerde, kadı ya da nâibi tarafından tutulan kayıtların toplandığı defterlerdir. Bu defterlere `Şer'iye Sicilleri veya Kadı Defterleri` de denilmektedir Kadılar tarafından tutulan bu defterlerde kadı'nın kendi vermiş olduğu hüccet ve i'lâmlar yanında devlet merkezinden gönderilen fermanlar, berâtlar, tezkereler, buyuruldular, rü'uslar ve mektûblar da yer almaktadır. Bu çalışmanın kaynağını teşkil eden 16 Numaralı Konya Şer'iye Sicili, 1672-1673 tarihlerine ait olup Konya'nın sosyal, siyasî, ekonomik ve hukûkî yapısı ile ilgili 100 çeşitten fazla dava konusunu içermektedir. Olaylar Konya Eyâleti içerisinde geçmekle birlikte çoğunlukla Konya'da yaşanan olayları konu edinmektedir.Okunuşu gerçekleştirilen belgeler içeriklerine göre sosyal, siyasî, ekonomik ve hukukî hayatla bağlantıları açısından ayrı ayrı değerlendirilmiştir. Sosyal hayatla ilgili konuları namzed, nikâh, boşanma; ekonomik hayatla ilgili konuları vakıf, mülk satışları, alacak-verecek davaları ve vergilerle ilgili kayıtlar; siyâsî ve idârî hayatla ilgili konuları ferman, berat, mürâsele, tezkere, buyuruldu, mektûb, hüccet; hukûkî hayatla ilgili konuları ise ölüm keşfi, nafaka takdiri, köleler ve câriyeler, kapıya katran sürme, rıza senedi, çeşitli suçlar vb. oluşturmaktadır.Bu bilgiler ışığında değerlendirmeler yapılmış ve dönem hakkında Konya'daki yaşam tarzı, işlenen suçlar, ekonomik yapı ve siyasi hayatla ilgili genel yargılara varılmıştır.Anahtar Kelimeler: Konya, Şer'iye Sicilleri, Kadı, Mahkeme, Dava.

The register is a notebook in which the records kept by kadi or nâibi are collected in the shari'a courts, which continued until the last years of the Ottoman State. These notebooks are also named as `Sheride Records or Kadi Notebooks`. These books, which are kept by the kadis, include the decrees, charters, compasses, duties, and the letters sent from the state center besides the hujjats and writes which were given them by kadi. Konya Şer'iye Sicili, number 16, which constitutes the source of this work, belongs to 1672-1673 and contains more than 100 kinds of lawsuits concerning the social, political, economic and legal structure of Konya. It included the events take place in Konya Province, but mostly in Konya. The documents that been read were evaluated separately in terms of their connections with social, political, economic and legal life according to the contents. Issues related to social life constitue naminee, marriage contract, divorce; ıssues related to economic life, foundations, property sales, assets and liability actions and taxation; the issues related to political and administrative life, edicts, berats, religions, compasses, orders, letters, huccets; the issues related to the legal life, discovery of death, alimony, slaves and handmaidens, tarring, consent, various crimes and so on. It was evaluated in the light of this information and general judgments were made about Konya life style, crimes committed, economic structure and political life.Key words: Konya, Sheride Records, Kadi, Court, Lawsuits.
