Abstract

ABSTRACT This study of ours is composed of three main parts. The first one contains the historical development of the Council of Europe and European Convention on Human Rights, the scope and features of the convention, the structure, formation, function and working methods of the European Commission of Human Rights. The Second one consists of the European Courts of Human Rights, that is, in other terms Divan, its formation, structure, characterics, meeting style, judging method, authority, authority restrictions, the admittance of the Divan's authority by Turkey, the characteristics of the Divan's judging methods, litigation, the examination of the case and the compulsory state of the decisions at the international platforms, taken by the Divan after the examination of the case. Ru addition, efforts have been made to explain the quality and practice of the Divan's decisions, their effects, compulsion in terms of national law, the effects of compromising solutions on the national law and responsibilities of participant states. Besides, new regulations forced by the protocol 11. have been analyzed. The third part states, the duties, structure and action of the committee of Ministers of the council of Europe, Which can be named as the supervisor to ensure the putting in force, feasibility and execution of the decisions taken by the European Court of Human Rights, and the Committee of Ministers as a decision taken organ. İn the conclusion part, a brief summary, a critic and approvals have been presented to finalize the thesis.
