Türkiye`de cumhurbaşkanına ilişkin güncel tartışmalar

Abstract

1982 Anayasasının yapıldığı günün koşulları nedeniyle, güçlü yürütme erkiyaratma çabası içine girmesi ve de yürümenin bir kanadı olan Cumhurbaşkanınageniş yetkiler vermesi, Anayasanın kabul ettiği Parlamenter Sistemin düzgünişlemesine mani olmuştur. Klasik Parlamenter Sistemin sorumsuz ve devletintemsili niteliği dışında işlevi olmayan Cumhurbaşkanının bu niteliklebağdaşmayacak şekilde geniş görev ve yetkilerinin olması sürekli olarak tartışmakonusu olmuştur. Anayasanın yapıldığı dönemden bu güne zaman zaman,cumhurbaşkanlarının Anayasanın kendilerine verilen bu görev ve yetkilerinikullanmaları mevcut hükümetlerle ciddi krizler yaşanmasına sebebiyet vermiştir.Bu tezde de cumhurbaşkanının sistem içinde tartışma yaratan yetki ve görevlerininhangileri olduğu, bunlara ilişkin sunulan çözüm önerileri ve güncel tartışmalarirdelenmiştir.Tezi Hazırlayan : Rıdvan EROL

The Constitution of 1982, prepared in parallel with the current conditions of itsarrangement period that has exerted for a potent execution and hence granted vastprivileges to the President who is a part of execution, has impeded a properperformance of the parliamentary system adopted by the Constitution. A lot ofcontinuous controversy has been generated over the cited mission and vast power thatdoes not accord with the President?s function in a Classical Parliamentary System whichis mere ceremonial representation of the state without bearing any responsibility. Theexercise of this power granted by the Constitution, from time to time, has caused seriouscrisis between the then existent governments and the president since the preparationperiod of the Constitution.
