Rekabet hukukunda ABC bilgi değişimi

Abstract

ABC bilgi değişimi (hub & spoke) son dönemde rekabet hukuku öğretisinin ve uygulayıcıların dikkatini çeken, diğer rekabet hukuku ihlal türlerinden farklılaşan yeni bir konudur. ABC bilgi değişiminin genel yapısı, genellikle ihlal kararları kapsamında anlaşılmakta birlikte öğretide ve uygulamada hukuki niteliği halen tartışılmaktadır. İngiltere rekabet otoritesinin 2003 yılında verdiği ilk ABC bilgi değişimi kararından bu yana AB üye ülkeler rekabet otoriteleri ve ABD mahkemeleri ABC bilgi değişimine dair kararlar vermeye devam etmiştir. Türk Rekabet Kurulu da son dönemde ABC bilgi değişimi tartışmalarını içeren soruşturmalar yürütmüştür. Çalışmamızda ABC Bilgi Değişimi kavramının kaynağı, bu atipik ihlal türünün niteliği, tarafların hukuki sorumluluğu, ABC bilgi değişiminin bir ihlal türü olarak dikey mi yoksa yatay mı olduğu, bu ihlal türünün nasıl ispat olunacağı,bu ihlal türünün hukuki nitelendirmesinin neden önemli olduğu ve bu ihlale nasıl yaptırım uygulanacağı konuları üzerinde durulacaktır. İngiltere ve Kıta Avrupası rekabet otoritelerinin ve ABD mahkemelerinin kararlarına çalışma içindeki bölümlerde karşılaştırmalı inceleme olarak değinilmiştir. Türk Rekabet Kurulu'nun ABC bilgi değişimi tartışmalarının yapıldığı üç kararına çalışmamızın son bölümünde yer verdik. Bu kararlar üzerinden Rekabet Kurulu'nun ABC bilgi değişimi tanımına, soruşturma evresinde ABC bilgi değişiminin ispatı için hangi unsurların varlığının arandığına değinilmiştir.

ABC information exchange (hub & spoke) is a new subject that differentiates itself from other types of competition law violations that have recently attracted the attention of competition law doctrine and practitioners. The general structure of the ABC information exchange is usually understood in the context of infringement decisions, but the legal nature of it is still being discussed. Since the first ABC information exchange decision of the UK competition authority in 2003, the EU member states have continued to make decisions about competition authorities and ABC information exchange with US courts. The Turkish Competition Board has also recently conducted investigations involving ABC information exchange discussions.The source of the ABC Information Exchange concept, the nature of this atypical infringement, the legal responsibility of the parties, whether the ABC exchange of information is vertical or horizontal as a breach, how this breach should be proven, why it is important to know the legal nature of this breach, the issues to be sanctioned will be emphasized. The decisions of the Competition Authorities of the United Kingdom and Continental Europe and the courts of the United States have been referred to as comparative examinations in the working sections.We have included in the final part of our work on the three decisions of the Turkish Competition Board concerning ABC information exchange discussions. The Competition Board's definition of ABC information exchange was based on these decisions, and the elements of ABC information exchange for prosperity were sought in the investigation phase.
