Abstract
Pek çok ülkede olduğu gibi, ülkemizde de taşeronluk veya alt işverenlik olarak tanımlanan ve asıl işverenin çeşitli işlerinin başka işverenlere gördürülmesi şeklinde gerçekleşen iş ilişkisi giderek yaygınlık kazanmıştır. İnşaat ve lojistik faaliyetlerde başlayan bu uygulama sonraki yıllarda tüm sektörlerde yaygınlaşmıştır. Alt işveren ilişkisinin üretimin hızlanması maliyetlerin düşmesi ve rekabetin artması gibi faydaları olabildiği gibi çalışanların haklarını kısıtlayıcı ve iş sağlığı ve güvenliği bakımından olumsuz sonuçlar doğurabilecek yönleri bulunmaktadır. Üçlü iş ilişkilerinden olan alt işveren ilişkisinde hem asıl işverenin hem de alt işverenin çalışanlara karşı birtakım yükümlülükleri bulunmaktadır. İşverenin çalışanı gözetme ve koruma borcu kapsamında iş sağlığı ve güvenliği tedbirlerinin alınması en temel yükümlülüklerdendir. Çalışmamızın ilk aşamasında alt işveren ilişkisinin kurulması ve şartları, kurulduktan sonra tarafların yükümlülükleri `6331 Sayılı İş Sağlığı ve Güvenliği Kanunu` ile bu kanuna istinaden çıkartılan yönetmelikler ve uygulama ekseninde değerlendirilmiştir. İkinci aşamada çok kriterli karar verme metotlarından AHP, TOPSIS ve VIKOR ile alternatif alt işverenler arasında iş sağlığı ve güvenliği kriterleri gözetilerek seçme ve sıralama yapılabileceği ortaya konulmuş, her bir yöntem için uygulama gerçekleştirilerek değerlendirme yapılmıştır. As in many countries, in our country, the business relationship, which is defined as subcontractor, is made widespread in the form of showing various jobs of the main employer to other employers. This practice started in construction and logistics activities and became widespread in all sectors in the following years. The subcontractor relationship has benefits such as accelerating production, decreasing costs and increasing competition. However, there are aspects that restrict the rights of employees and may have negative consequences for occupational health and safety.In the subcontractor relationship, which is a tripartite business relationship, both the principal employer(contractor) and the subcontractor have certain obligations towards the employees. Taking the occupational health and safety measures within the scope of the employer's supervision obligation is one of the main obligations. In the first phase of our study, the establishment and conditions of the subcontractor relationship, the occupational health and safety obligations of the parties, the Occupational Health and Safety Law No. 6331 and the regulations related to this law were evaluated within the application axis. In the second stage, it has been demonstrated that AHP, TOPSIS and VIKOR methods, which are multi-criteria decision-making methods, can be selected and ranked among alternative subcontractors by considering occupational health and safety criteria, and the application has been made for each method.
