Abstract

İslam devletleriyle Müslüman olmayan devletler arasındaki mali sözleşmlerinhükülerinin bilinmesi hem genelde tüm Müslümanlar özelde Müslüman tücarlaraçısından önem arz etmketedi.`Uluslararası Mali Sözleşmeler Hükmü` başlıklı tezimizde bir giriş üçbölümden oluşmaktadır. Tezimizde konular mukayeseli bir şekilde ele alınmıştır.Giriş bölümünde üç konu incilenmiş. İlk kısımda sözleşmenin ve sevrvetin tanımı elealınmış. İkinci kısımda, İslam devleti, İslami olmayan devlet ve devlet mefhumukavramları incelenmiş. Üçüncü olarak uluslararası ekonomik ilişkilerin ahlaki boyutu,İslam hukuku kurallarına uyma, mütekabiliyet ve en son uluslararası koşullar ilkesidikkate alınarak, İslam'da uluslararası ekonomik ilişkileri düzenleyen hususlartartışılmıştır.İkinci bölümde, faizli sözleşmenin tanımı, hükmü ve İslam devleti ile yabancıdevlet arasındaki yapılana faizli sözleşmlerin hükmü ele alınmıştır. Üçüncü bölümde,borsanın tanımı, yönetişimi, bankalar arası para transferleri ile ilgili kurallar veuluslararası döviz sözleşmeklerindeki tarihleme kuralı ele anmıştır.Uluslararası Hizmet Sözleşmelerinin ikinci bölümünde üç başlığa yerverilmiştir. Birinci başlık altında Uluslararası Hizmet Sözleşmelerde yönetilenkrediye karşı banka faizi alma kararı ve IMF'den borçlanma kararı ele alınmştır.Ticaret Sigortaları Kanunu'nun ikinci bölümünde ise, sigorta sözleşmesinin tanımı,menşei, türleri ve kararı işlenmiştir. Elektronik sözleşmelerin üçüncü bölümünde,sözleşmelerin türleri, hükümleri, yazım yöntemi ve benzer araçlar için sözleşmekuralı, ve modern iletişim yöntemi üzerinde sözleşme kuralı ve internet sitelerindeyapılan sözleşmenin sona ermesi üzerinde yapılan sözleşmler incelenmiştir. Bubölümde ayrıca uluslararası mali tazminat sözleşmelerinin hükümleri ele alınmıştır.İkinci bölümde kiraya sözleşmesi tartışılmıştır. Burada Kira sözleşmesininyasallığı açıklanmış, akabinde genel olarak uluslararası kiralama sözleşmesininkuralları ve kiraya veren ile yabancı kiracı arasındaki kira sözleşmesi ve yabancıkiralayan ile kiralayan arasındaki ilişki incelenmiştir. Ayrıca bir yabancıyı, kendidinleriyle ilgili bir çalışma yapmaya ve yabancı için özel bir ücret de olsa Müslümanbir yabancının işe alınma kuralı ele alınmıştır. The first section I talked aboutthe definition of language, language and definition of money. In the second section, Italked about the Islamic view of the globe. Which I talked about the concept of theIslamic state and the non-Islamic state, and the concept of the state treaty. The thirdsection discusses the most important principles governing the international economicrelations in Islam, namely, taking into account the moral dimension of internationaleconomic transactions, adherence to the rules of Islamic law, reciprocity and theprinciple of the most international condition.The first chapter deals with the definition of the contract of sale in terms oflanguage and terminology, its legitimacy, and the statement of the rule of dealing withselling and buying between the Islamic state and the foreign state. In the third section, I talked about the definition of exchange, its rule, therule of bank transfers, and the rule of dating on the international exchange contract.In the second chapter on International Services Contracts, it included threesection, in the first section I talked about the contract of the international loan. Itdefined and governed the ruling on taking bank interest against the loan and the rulingon borrowing from the IMF. In the second section of the Commercial Insurance Law,the definition of insurance contract, its origin, types and ruling was defined.
