Kadastro çalışmalarında risk değerlendirmeleri üzerine bir araştırma

Abstract

30.06.2012 tarih ve 28339 sayılı Resmi Gazetede yayımlanarak çalışma hayatına giren İş Sağlığı ve Güvenliği Kanunu kamu ve özel sektöre ait bütün işlere ve işyerlerine, bu işyerlerinin işverenleri ile işveren vekillerine, çırak ve stajyerler de dâhil olmak üzere tüm çalışanlarına faaliyet konularına bakılmaksızın uygulanmaya başlanmıştır. Kamu kurumlarında kanunun 6'ncı maddesi iş sağlığı ve güvenliği hizmetleri ile 7'nci maddesi iş sağlığı ve güvenliği hizmetlerinin desteklenmesi 01.07.2020 tarihinde uygulanmak üzere yürürlüğe girmiştir. Bu kapsamda Tapu ve Kadastro Genel Müdürlüğü (TKGM) 01.07.2020 tarihi itibariyle iş sağlığı ve güvenliği hizmetlerine başlamak zorundadır. Bu güne kadar kadastral faaliyetleri yerine getiren Tapu ve Kadastro Genel Müdürlüğüne bağlı Kadastro Müdürlüklerinde iş sağlığı ve güvenliği hizmetlerinin yürütülmesinde yeterli bir akademik çalışmaya rastlanmamıştır. Bu konudaki eksiklikten dolayı tez çalışmasında Kadastro Müdürlüklerinde çalışan personelin çalıştıkları iş ve işlemlerde maruz kaldıkları veya kalabilecekleri tehlikeler ve bu tehlikelerden doğabilecek riskler araştırılarak risk değerlendirmesinin şablonu oluşturulmaya çalışılmıştır.Birleşmiş Milletler üyesi ve Avrupa Birliği adaylık sürecindeki ülkemizin, köklü ve değişimlere her zaman ayak uyduran kurumu TKGM'nün iş sağlığı ve güvenliği konusunda bir an evvel adımlar atması ve ülkenin bu konuda öncü kurumlarından biri olması beklenmektedir.Hazırlanan bu çalışma ile Avrupa standartlarına uygun bir risk değerlendirmesi yapılarak TKGM'nün yönetim organizasyon şeması içerisindeki yönetici ve çalışanlarının örnek alabilecekleri İş Sağlığı ve Güvenliği kavramını kazandırmak ve bilgi kılavuzu oluşturmak amaçlanmıştır.Çalışma toplam dört bölümden oluşmaktadır. Giriş bölümünde iş güvenliğinin kadastro faaliyetlerinde önemi, çalışmanın amacı ve kapsamı açıklanmıştır.İkinci bölümde iş sağlığı ve güvenliği kavramı ile ilgili terimlerin tanımları açıklanmış ve tarihi gelişiminden bahsedilmiş, ülkemizdeki ve dünyadaki önemi açıklanarak ülkemizdeki iş sağlığı ve güvenliği konusundaki hukuksal mevzuat incelenmiştir.Üçüncü bölümde risk değerlendirme yöntemlerinden bahsedilerek çalışmanın uygulama kısmında kullanılacak risk değerlendirme yöntemine karar verilmiştir.Dördüncü bölümde Kadastro Müdürlüklerinde çalışan personel ile yapılan anketler yardımıyla ve Tapu ve Kadastro Genel Müdürlüğünün mevzuatları açısından tehlikeler belirlenerek örnek bir risk analizi yapılmıştır.

The Occupational Health and Safety Law, which entered into the business life by being published in the Official Gazette dated 30.06.2012 and numbered 28339, has started to be applied to all businesses and workplaces belonging to the public and private sector, employers and employers' representatives of these workplaces and all employees including apprentices and trainees regardless of their field of activity. In the public institutions, the 6th article of the Law regarding occupational health and safety services and the 7th article of the Law regarding occupational health and safety services have come into force to be apllied on 01.07.2020. Within this scope, General Directorate of Land Registry and Cadastre (TKGM) has to start occupational health and safety services as of 01.07.2020. A sufficient academic study in conducting occupational health and safety services in the Cadastre Directorates of the General Directorate of Land Registry and Cadastre, which carry out cadastral activities has not been found so far. Due to the lack in this subject, a template of risk assessment was tried to be created by investigating the risks that personnel working in the cadastral offices may be exposed to or may be exposed to in the works and transactions they work in and the risks that may arise from these risks It is expected that TKGM, which always keeps pace with the changes and which is a rooted institution of Turkey, which is a member of the United Nations and is in the process ofEuropean Union candidacy, will take steps as soon as possible and to become one of the leading institutions of the country on occupational health and safety. The aim of this study is to make a risk assessment in accordance with European standards and to constitute the concept of Occupational Health and safety and to create an information guide that can be used as an example by managers and employees within the management organization chart of TKGM. The study consists of four chapters. In the introduction chapter, the importance of occupational safety in cadastral activities, purpose and scope of the study are explained.In the second chapter, the terms related to the concept of occupational health and safety are defined, the historical development of occupational health and safety is mentioned, the importance of occupational health and safety in our country and in the world is explained and the legal regulations on occupational health and safety in our country is examined.In the third part, risk assessment methods were discussed and the risk assessment method to be used in the application part of the study was decided.In the fourth chapter, a sample risk analysis was carried out by determining the dangers in terms of the regulations of the Land Registry and Cadastre General Directorate with the help of surveys conducted by the personnel working in the Directorates of Cadastre.
