İslam Hukuku`na Göre tecavüze uğrayan kadının hak ve sorumlulukları

Abstract

Ahlakî değerlerin önemini yitirdiği günümüzde İslam hukukunun insanlığa yeniden yol gösterici olacağı düşüncesiyle `İslam hukukuna göre tecavüze uğrayan kadının hak ve sorumlulukları` başlığında tezimiz yazılmıştır. Tezimiz toplumda yerleşmiş yanlış uygulamaların kaynağının İslam hukuku olduğu düşüncesini değiştirmek ve geçmiş milletlerin yerel kanunlarından ve günümüzde de varlığını sürdüren töre kaynaklı olduğunu ispatlamak amacı gütmektedir.Tez yazılırken öncelikle ayet ve hadislerin daha sonra İslam hukukçularının klasik dönem eserlerinden istifade edilmiştir. Yakın zamanda Osmanlı dönemi araştırmaları üzerine yapılmış olan makale ve tez çalışmalarına da başvurulmuştur.Tezimiz giriş ve sonuç hariç iki bölümden oluşmaktadır. Birinci bölümde bu alanla ilgili kavramlara genişçe yer verilmiş daha sonra da ikinci bölümde tezimizin amacı dahilinde bulunan veriler toplanarak tezimiz tamamlanmıştır.Anahtar Sözcükler: Cinsel Taciz, Tecavüz, Irza Geçme, Kadın Hakları, İslam Hukuku

Our thesis is written under the title of Rights and Responsibilities of Raped Women in Islamic Law with the idea that Islamic Law will guide again in these days when moral values have lost their importance. Our thesis aims to change the idea that Islamic Law is the source of the wrong practices established in the society and to prove that these practises originate from the practices that are common in the local laws called custom.While the thesis is being written, firstly verses and hadiths, in addition to this the classical period works of the scholars who have been doing Islamic studies were used. The latest articles and theses on the Ottoman period researches were also examined.Our thesis consists of two chapters except the introduction and conclusion. In the first part, the concepts related to this field are explained and in the second part, the data within the aim of our thesis is collected and our thesis is completed.Keywords: Assault, sexual harassment, fornication, infidelity, rape, women's rights, islamic law
