Abstract
Bu çalışma, Türk hukuk sisteminin AB hukuk sistemi ile uyumlaştırılması çerçevesinde, AB rekabet hukuku referans alınarak çıkartılan Rekabetin Korunması Hakkındaki Kanun'un özel hukuk alanındaki yaptırımlarından olan tazminat sorumluluğunu karşılaştırmalı olarak incelemeyi amaçlar. İnceleme üç bölümde yapılmıştır. Rekabet hukukunda sorumluluk ve şarkları başlığı altında, sorumluluğun şartları ve hukuka uygunluk nedenleri birinci, zarar ve tazminat başlığı altında tazminatın türleri, zarar ve tazminatın belirlenmesi ile kapsamı bu husustaki hesap yöntemleri ile hukukumuzda olmayan ancak bu kanunda yer verilen üç kat tazminat ve şartları ile manevi tazminat ve şartları ikinci, yargılama usulü başlığı altında tazminat davası ve tarafları görevli ve yetkili mahkeme, ispat yükü ve deliller ile zamanaşımı ve Rekabet Kurulu ile genel mahkemeler arasındaki ilişki ise üçüncü bölümde incelenmiştir. Çalışmada, farklı görüşlere yer verilmek suretiyle yorumlar yapılıp sonuçlar çıkartmak amaçlanmıştır. The purpose of this study is to comparatively examine the liability for damages, one of the sanctions the Protection of Competition Law under the scope of private law, which is enacted according to the EU Competition Law within the framework of harmonization of Turkish Legal System with EU Legal System. The review has been conducted in three sections. Conditions of liability and the cause of justifications are examined in section one under the title of liability in Competition Law and its conditions; types of compensation, determination of damages and scope of compensation, calculation methods , treble damages and conditions which are not regulated under Turkish Legal System but stipulated in this law, non-pecuniary damages and its conditions are examined in section two under the title of damages and compensation; action for compensation and parties, competent courts, burden of proof, evidences, statute of limitations, the relation between Competition Board and general courts are examined in section three under the heading of proceedings. In this study, it is intended to make interpretations and conclusions by evaluating different opinions.
