Amirin emrini yerine getirmenin ceza sorumluluğuna etkisi

Abstract

Türk Ceza Kanunu'nun 24'üncü maddesinde ?amirin emrini yerine getirme?, ceza sorumluluğunu kaldıran veya azaltan nedenler başlığı altında düzenlenen konulardan birisidir. Kanun hükmünü yerine getirme, 24'üncü maddenin birinci fıkrasında düzenlenmişken amirin emrine ilişkin bu hüküm 24'üncü maddenin devam eden fıkralarında yer almaktadır. Çalışmamız bu sebeple 24'üncü maddenin 2, 3 ve 4. Fıkralarına ilişkin olacaktır.

Within the Article 24 of the Turkish Penal Code, ?Execution of Director?s Command? is one of the subjects that was taken part, under the topic of Reasons for Abolishing or Mitigating the Criminal Liability. While ?The Execution of the Provision of Law? was issued under Article 24 paragraph 1, there are provisions pertaining to the ?Execution of Director?s Command? under the paragraphs two, three and four of the same article. So in our study we will focus on these paragraphs.
