Abstract
Vergi hukukunda, delillerin temel işlevi, vergisel nitelikteki maddi olayın ortaya konulması için yargıca, vereceği hüküm için bir dayanak oluşturmaktır. İspat değeri taşıyan her delilin, vergi yargılamasında ispat aracı olarak kullanılabilmesi olanaklı değildir. Deliller, hukuka uygun şekilde elde edilip edilmediğinin ya da uyuşmazlığın çözümüne etkisi olup olmadığının belirlenmesi için değerlendirmeye tabi tutulur. Vergi uyuşmazlıklarında nihai değerlendirmeyi yapacak olan yargıçlar, vergi yargılama hukuku kurallarını belirleyen delil sistemini, yorum ilkelerini ve nihayet delillerin değerlendirilmesinde kullanılan yargılama hukuku ilke ve yaklaşımlarını göz önünde bulundurarak bir karara varmaktadır. Diğer yandan, delillerin yargılamadaki hukuki değerinin belirlenebilmesi için, delillerle ortaya konulan maddi olaya uygulanacak olan pozitif hukuk normunun doğru bir şekilde saptanması ve yorumlanması gerekmektedir. Yargısal uyuşmazlıkların çözümünde delillerin işlev ve önemi kadar, uygulanacak pozitif hukuk normlarının ve yargılama hukuku ilke ve yaklaşımlarının yorumu üzerinde de durulması gerekmektedir. Vergi yargılaması gibi oldukça teknik bir hukuk alanında uygulamayla geliştirilen yargılama hukuku ilke ve kurallarının kapsam ve sınırlarının belirlenmesi, hukuki istikrarın sağlanması, adil yargılanma hakkının korunması ve maddi hukukun geliştirilmesi açısından önem arz etmektedir. Vergi yargılama hukukunda gerek içtihatlarda istikrarın sağlanması, gerekse de savunma hakkının etkin bir şekilde kullanılabilmesi açısından doktrin ve yargı içtihatlarıyla kapsam ve sınırları belirlenen yaklaşımların çeşitlendirilmesi ve farklı sistemlerdeki uygulama ve yaklaşımların karşılaştırmalı olarak değerlendirilmesi gerekmektedir. Bu bağlamda delillerin değerlendirilmesinde, Türk vergi yargılama hukukundaki ekonomik yaklaşıma karşılık, Amerika Birleşik Devletleri federal vergi yargılama hukukunda geliştirilen ekonomik esas, ticari amaç, esasın şekle üstünlüğü, sahte işlemler ve kademeli ticari işlem yaklaşımı gibi beş farklı vergi yargılama hukuku yaklaşımının karşılaştırmalı olarak incelenmesine çalışılmıştır. In the tax law, the main function of the evidence is to be a mainstay for the judge who gives rise the facts in the litigation in order to render a decision. On the other hand, every evidence that has a probative value cannot be used as proof in tax procedural law. With respect to the accessibility, evidence is evaluated in order to determine if it is relevant to the resolution of the litigation or if it is obtained illegally or not. Judges who will make the determinative assessment over the disputes in tax litigations, render decisions by taking into consideration the rules of tax procedural law, evidence system, interpretation principles, the procedural law principles and approaches that are used in the evaluation process of the evidence.On the other hand, in order to determine the legal value of the evidence in the judicial proceedings, the law in force that will be applied to the legal event in question, which is ascertained by the evidence, should be carefully settled and interpreted. In the resolution of the judicial litigations; the interpretation of the law in force and the rules, principles and approaches of the procedural law should be considered as much as the importance of the concrete evidence of the case. In terms of the protecting of the rigth to fair trial and development of the substantive law, ascertaining the content and borders of the principles and rules of the procedural law and ensuring the legal stability are of great importance in such a technical and complex legal field as procedural tax law.On the implementation of the tax procedural law, with regard to the either in ensuring the stability of the precedents or using the right of defence effectively, it is a necessity to diversify the judicial approaches, where their contend and borders are determined by the doctrine and precedents. And also, the judicial approaces and their implementations in different legal systems should be evaluated comparatively. With respect to the evaluation of evidence, economical approach as the sole judicial approach used in Turkish tax procedural law and five judicial approaches like business purpose, substance over form, sham transactions, economic substance and step transactions used in the United States have been comparatively construed.
