Abstract
İnsanlar tarih boyunca savaşlar, insan hakları ihlalleri, doğal afetler gibi nedenlerle yaşadıkları yeri terk ederek daha güvenli bir yaşam bulma umuduyla farklı ülkelere sığınmışlardır. Kabul ülkeleri, sığınmacı sayısının sınırlı olduğu hallerde kişilere daha kolay koruma sağlarken, sığınmacı sayısının yüksek olduğu kitlesel akın durumunda koruma sağlamakta güçlükler yaşamaktadırlar. Çok sayıda kişinin korunma ihtiyacına cevap verebilmek amacıyla getirilen çözümlerden birini `geçici koruma` rejimi oluşturmaktadır. Temel uygulaması ve hukuki çerçevesi Avrupa Birliği hukukunda belirlenen bu rejim, yaşamakta olduğumuz Suriye krizi bağlamında tekrar önem kazanmıştır.Coğrafi konumu nedeniyle geçiş ülkesi özelliğini taşıyan Türkiye, son yıllarda Ortadoğu'da yaşanan iç savaş ve karışıklıklar sonucunda bir varış ülkesi niteliğini de kazanmıştır. Maruz kaldığı bu kitlesel akın karşısında, geçici koruma statüsünü yürürlüğe koymak suretiyle Suriyelilere koruma sağlamıştır. Ancak geçici koruma statüsü bir ara çözüm niteliğindedir ve makul bir süre geçmesine rağmen kişilerin menşe ülkelerine dönüşleri mümkün değilse bu halde, bu statünün kalıcı bir statüye evrilmesi gerekmektedir. Bu çalışma hem Avrupa Birliği Hukuku hem de Türk Hukuku bağlamında kitlesel akın durumlarında geçici koruma statüsünü incelemekte; bu statünün kişilere sağladığı hakları ve yükümlülükleri karşılaştırmalı hukuk bağlamında ele almak suretiyle Türk Hukuku'ndaki geçici koruma uygulamasına katkıda bulunmayı amaçlamaktadır. Throughout history, masses of people having left their countries of origin for reasons such as wars, human rights abuses or natural disasters have taken refuge in various countries in pursuit of a safe haven. Host countries provide sufficient protection for asylum seekers in limited number, yet face difficulties in granting protection in the case of mass influxes, where the number of asylum seekers is relatively high. `Temporary protection` regime is one of the immediate solutions to fulfil the protection needs of many people. Basic application and legal framework of this regime are set out in European Union law and has gained importance in the context of the Syrian crisis with which we have been confronted recently.Due to its geographical location, Turkey, once a transit, has also emerged as a destination country as a result of civil war and turmoil in the Middle East in recent years. Turkey has put the temporary protection status into effect in order to cope with the massive influx of migration. However, the temporary protection status offers merely a short term solution, therefore, if temporarily protected people can not return to the countries of origin in a reasonable period, the legal framework recognized as `temporary protection` must evolve into a `permanent status`, that is more comprehensive and well-structured legal grounding that would offer a long term solution to the crisis and ultimately result in the integration of Syrian refugees into Turkish society.This current study examines the temporary protection regime in mass influx situations both in the context of European Union Law and Turkish Law, and aims to fill the gap in Turkish Law through the study of rights and obligations of temporary protected status of people in the context of comparative law.
