Türk hukukunda boşanmanın eşler arasındaki mali sonuçlarından maddi tazminat ve manevi tazminat

Abstract

Evlilik birliğinin sona erme sebeplerinden biri olan boşanma sonucunda taraflardan birinin zarara uğramış olması muhtemeldir. Çalışmamızda boşanma sonucunda zarara uğramış olan tarafın bu zararını tazmin etmesini ele aldık. Çalışmamızın üst başlığı boşanmanın sonuçları olacağından genelden özele bir inceleme yolunu tercih ederek boşanmanın eşler açısından sonuçlarına da kısaca yer verdik. Sonrasında çalışmamızın ana konusunu oluşturan boşanmaya, boşanmanın sebeplerine ve boşanma sonucunda oluşan mali sonuçlara değindik. Çalışmamızda boşanma sebebiyle istenecek olan maddi tazminat ve manevi tazminatın şartlarına, bu tazminatların talep biçimlerine ve diğer sonuçlarla olan ilişkilerine de yer verdik.

It is likely that one of the parties has suffered a loss as a result of divorce which is one of the reasons for the termination of the marriage union. In our study, we have discussed the compensation of the damages. Since the top title of our study will be the results of divorce, we have briefly included the results of divorce from the point of view of the spouses, preferring a special examination path from the general. After that, we touched upon the divorce, the reasons of divorce and the financial consequences of divorce. In our study, we have included the conditions of pecuniary damages and non-pecuniary damages which will be requested due to divorce, the forms of demand of these compensation and their relations with other results.
