Hidroelektrik santrallerin hukuki açıdan incelenmesi (İkizdere vadisi-Rize örneği)

Abstract

Türkiye'nin yenilenebilir enerji kaynaklarına yönelmesi bir zorunluluk haline gelmiş bulunmaktadır. Bu nedenle devlet, yenilenebilir enerji kaynaklarına yönelmiş, ülkenin morfolojik yapısı nedeniyle özellikle akarsular üzerinde Hidroelektrik Santrali (HES) kurulmasını teşvik etmiştir. Hidroelektrik santrallerin çevresel etkilerinin hukuki düzenlemelerde yerinin incelenmesi öncelikli konuların başında gelmektedir.Çalışmada, Türkiye'de hidroelektrik santrallerin hukuki düzenini incelemek, çevresel etki değerlendirilmesi sisteminin yeterliliğini ortaya koymak, bu düzeni Türkiye'nin taraf olduğu uluslararası sözleşmeler ile ilgili mevzuatta yer alan kriterlere göre değerlendirerek önerilerde bulunmak amaçlanmıştır. Bu doğrultuda; değişen hukuki kaynaklar ve küreselleşme yolunda atılması gereken adımların planlanması önem arz etmektedir. Sonuçların uygulamaya entegre edilmesi ise çalışmanın ana hedeflerindendir.

Nowadays the orientation of Turkey to renewable energy sources has become a necessary. Therefore, the government is directed to renewable energy sources. Due to morphological structure of the country, establishment of Hydroelectric Power Plants (HPP), especially on rivers is encouraged. So studying the role of the legislation in environmental impacts of hydroelectric power plants from renewable energy sources is one of the priority issues.In this study, the investigation of legal procedure of hydroelectric power plants in Turkey, demonstration of sufficiency of the environmental impact assessment system, evaluating of local relevant legislation criteria's with the international conventions, is aimed. In this context, planning of the steps, which must be taken towards globalization and changeable legal sources, is important. Finally the integration of the results with applied system is one of the main objectives of this study.
