Abstract
Mevcut çalışma öncelikle Walter Benjamin'in hukuk ve şiddet ile ilgili düşüncelerinden hareketle iki olgunun politik felsefedeki kapsamlarını konu edinmektedir. Çalışmada, Benjamin'in şiddet eleştirilerinden yola çıkarak mevcut hukuk sistemlerinin adalete neden imkan sağlayamayacağını sorgulamaya çalıştık. Bu amaçla hukuk felsefesinin iki ekolü olan doğal hukuk ve pozitif hukukun kökenindeki şiddet olgusu nedeniyle son kertede metafizik bir karaktere büründüğünü iddia ettik ve söz konusu karakterin iktidar alanlarında nasıl tezahür ettiğini açığa çıkarmaya çalıştık. Bu nedenle Benjamin'in ileri sürdüğü `mesiyanik şiddet` anlayışını ve bu anlayış ile adaletin nasıl tezahür edebileceğine dair sunduğu imkanların izini sürmeye çalıştık.Anahtar Kelimeler: Hukuk, Şiddet, Doğal Hukuk, Pozitif Hukuk, Adalet This work focuses primarily on Walter Benjamin's views on law and violence and the scope of the two phenomena in political philosophy. In this study, we tried to question why the existing legal systems cannot provide justice based on Benjamin's criticism of violence. For this purpose, we have claimed that due to the fact of violence at the origin of natural law and positive law, which are the two schools of philosophy of law, it has recently taken on a metaphysical character and we have tried to reveal how this character manifests in the fields of power. For this reason, we tried to trace Benjamin's understanding of `mesianic violence` and the opportunities it provides for how justice can manifest with this understanding.Keywords: Law, Violence, Natural Law, Positive Law, Justice
