Abstract
Ceza Muhakemesi Kanunu madde 253 ve devamında düzenlenen uzlaşma;uzlaşma kapsamına giren bir suç nedeniyle, şüpheli veya sanık ile suçtan zarargörenin Ceza Muhakemesi Kanunu ve Ceza Muhakemesinde UzlaştırmaYönetmeliği'ndeki usul ve esaslara göre anlaşmış olmalarını ifade etmektedir.Uzlaştırma ise Cumhuriyet savcısının onayıyla görevlendirilen ve uzlaştırmamüzakerelerini yöneten uzlaştırmacı tarafından, taraflar arasındaki uyuşmazlığınbahsi geçen Kanun ve Yönetmelik'teki usul ve esaslara uygun olarak anlaştırılmalarıyoluyla uyuşmazlığın giderilmesi sürecidir.Suçtan zarar gören ile şüpheli ya da sanık arasındaki uyuşmazlığınçözümünü hedefleyen uzlaşma, aynı zamanda toplumda barışın sağlanmasıbakımından da önemli bir kurumdur. Klasik ceza muhakemesinden, temelindekionarıcı adalet anlayışı nedeniyle farklı olan bu kurum, mağdurun korunmasınıamaçlayan bir yapıya sahiptir. Ceza hukuku sistemimizdeki önemi nedeniyle,tezimizde Ceza Muhakemesinde Uzlaşma konusu ele alınmıştır.Tezimiz üç bölümden oluşmakta olup, birinci bölümde uzlaşma ile uzlaştırmakavramları, uzlaşmanın düşünsel kökeni ve alternatif uyuşmazlık çözümleri, diğerhukuklarda, bölgesel ve uluslararası belgelerde uzlaşma ve Türk hukukundauzlaşma ile ilgili genel bilgiler verilmiştir. İkinci bölümde, uzlaşmanın taraflarına vekoşullarına detaylı olarak yer verilmiştir. Üçüncü bölümde ise önce uzlaşmanınsoruşturma ve kovuşturma evresindeki ortak hükümlerine yer verilmiş, daha sonraayrı iki başlık halinde soruşturma ve kovuşturma evresinde uzlaşma usulüne vesonuçlarına değinilmiştir. Bu çalışmanın amacı, uzlaşma ve uzlaştırmaya ilişkinyasal düzenlemelerin incelenmesi ile doktrinde ve uygulamada tartışmalı konularınirdelenmesidir. Reconciliation regulated in Article 253 and the rest in Criminal ProcedureLaw means, that the suspect or defendant and the victim of a crime due to a crimewithin the scope of reconciliation have reached agreement with the procedures andprinciples of the Criminal Procedure Law and the Regulation on Conciliation inCriminal Procedure. Conciliation is the process of settling the dispute by theconciliator who is appointed by the public prosecutor, manages the conciliationnegotiations by agreeing the dispute between the parties in accordance with theprocedures and principles mentioned Law and Regulation.Reconciliation, which aims to resolve the dispute between the offender andthe suspect or defendant, is also an important institution in terms of peace insociety. This institution, which differs from classical criminal procedure due to itsrestorative understanding of justice, has a structure aimed at protecting the victim.Due to its importance in our criminal law system, Reconciliation in CriminalProcedure Law is discussed in our thesis.Our thesis consists of three chapters. In the first chapter, general informationabout reconciliation and conciliation, intellectual origins of reconciliation andalternative dispute resolution, reconciliation in other laws, regional and internationaldocuments and reconciliation in Turkish Law are given. In the second chapter, theparties and the conditions of reconciliation are explained in detail. In the thirdchapter, firstly the common regulations of reconciliation in the investigation andprosecution phase are mentioned and then the reconciliation procedure and itsresults in the investigation and prosecution phase are mentioned in two separatetitles. The aim of this study is to examine the legal arrangements related toreconciliation and conciliation also to discuss controversial issues in doctrine andpractice.
