Abstract
Bu araştırmamızdaki amaç; geçmişten günümüze Kürt alimlerinin İslam hukukualanında yapmış oldukları çalışmalar hakkında bilgi vererek, bizlere bırakılan zenginkültür mirasından istifade etmektir. Bu nedenden dolayı araştırmamızı iki bölüm altındainceleye çalıştık.Çalışmamızın ilk bölümünde Molla Yahya'nın ailesi, doğdoğu ve ilim tahsil ettiğiyerler, icazetiyle ilgili bilgiler, meşhur olan öğrencileri ve eserleri hakkında bilgivermektir. Tahkik ettiğimiz haşiyede kaleme almış olduğu eserinden bir tanesidir.Irakın içinde ve dışında döneminin büyük alimleri arasında gösterilen bu alimden,başta Kürt kabileleri olmak üzere Osmanlı devletide fetvalarından istifade etmiştir.Çalışmamızın ikinci bölümünde Molla Yahya el-Munzuri'nin Tahfetül Muhtachaşiyesinin taharet babından (konusundan) hadesin (abdestsizlik) sebeplerine kadar olanbölümün tahkik çalışmasını yaptık. Haşiyede geçen Kuran ayetleri ve hadisleri tespitederek kaynaklarını belirlemeye çalıştık. Bununla birlikte haşiyede geçen kavramlarınanlamını ve kaynalarını belirlemeye çalıştığımızı da ifade etmek isteriz. Haşiyede geçenbazı işaaretlerin ne anlama geldiğini ifade etmeye çalışırken eksik gördüğümüz yerleridipnotta açıklamaya çalıştık. Ayet ve hadislerle birlikte kitabın metninide paranteziçinde verdik. The aim behind the research is showing some of traditional texts of Islamicjurisprudence for making use of them and recovering the culture of kurds scientists andpresenting their struggle and tiredness for the sake of legal science and appearingtreasure from our Islamic cultural heritage and it is a great action, and because of that,we wanted to be a reason and a part of showing this precious, evaluative treasure. Weare going to present our research summary in to two points:-First: We have started our research about the life of the scientist( Alshekh)- the clergyman ( Yahia Bin Khalid Al-Mzoory).So ,the summary of this subject is that he was bornin one of the Mzoory villages, eastern Duhok city called (Balti) and his age was aboutone handred years. He has got his study from the (Mashaikh) teacher of his age inKurdistans Mosques and schools. And also he has got the science in all of Mosul,Baghda, Alsham, and he has received his scientific degree from (Malla) Mahmood Al-Amadi and the (Shekh) Ahmed Bin Obeid Al-Attar, Imam the Amawi Mosque in 1791.The next year, from the scientist Mohammed Bin Ahmed who is known (Badeer Al-Qudsy) and also he has received authorization in Al-Naqishabandia school from theshekh Khalid Al-Shahrazoory. He has studied in Amadia, Mosul and Baghdad. He hastaught thousands of the students of the science from various countries and areas, forexample, the famous explainer (Abi-Althana Al-aloosy, the shekh Noor Al-deen Al-Breefkany, Ibrahim Faseeh Al-haidary and Mulla Abdullah Al-Barzani and others). Hehas available scientific actions including: Alhashia which we are at the beginning of itsstudy-he had a great role in the social issues and reformation among people and thechange of judges in the region. The Iraqi people and all the Kurdish people inside andoutside Iraq act according to his legal opinion. So he gives a legal opinion in theOttoman state. The Ottoman Baghdad's waly (Dawood Pasha) gave him special place.لAt the late of his age, he settled at Baghdad and died there (1252-1853). He was buriedin the groweyard of the shekh Abdulqadir Al-Geilany.Second: After writing on the life of shekh, we started studying (the margin of MallaYahia Al-Mzoory on (Tuhfat Al-Muhtaj fee sharh Al-Minhaj) from the book Al-Taharato the part of the reasons of happening. After its change from the hand written, wefollowed in investigating this margin documenting the Quran Verses, the hollyprophetic traditions (Hadeeth) in their correct positions, remarkable sayings andreturning to their taking out resources, Identifying the scientific terms in the study andthe difficult terms. And we have changed the old spelling of some words in the handwritten to the new spelling. We have also changed the symbols in it to the inquiredwords from those symbols, and we have added to it what I saw missing, so we put thembetween brackets and we have pointed to them in the margin and we put the book `Tuhfat Al-Muhtaj fee sharh Al-Minhaj` between brackets, Quran's verses, prophetictraditions (Hadeeth) which have been taken from books and sayings.
