Marka hakkının ceza normları ile korunması

Abstract

Hukukumuzda, marka hakkına ve bu hakkın korunmasına yönelik düzenlemeler, 1850'li yıllardan itibaren başlamıştır. Teknik ve ekonomik gelişmeye paralel olarak, bu alandaki düzenlemelere ihtiyaç da her geçen gün artmıştır. Etki alanı nedeniyle, marka hakkının korunması için sadece hukuk davası yeterli olmadığından, ceza normlarına da ihtiyaç olmuştur. Bu ihtiyaç nedeniyle, bugüne kadarki tümdüzenlemelerde olduğu gibi, 6769 sayılı Sınai Mülkiyet Kanununda da, marka hakkını korumaya yönelik, cezai hükümlere yer verilmiştir. Bu çalışmada, marka hakkının ceza normları ile korunmasına yönelik düzenlemeler ve özellikle 6769 sayılı Sınai Mülkiyet Kanunda düzenlenmiş olan marka suçları incelenmiştir.

Regulations related with trademark right and protection of trademark right have been implemented into Turkish law system as of 1850's. In parallel with technical and economic progress, the need for regulations in this scope has increased day by day. Due to sphere of influence of the issue, not only civil litigations but also criminal regulations are needed. Due to the needs, such as former regulations, Law No. 6769 of December 22, 2016, on Industrial Property has regulated criminal provisions due to protect trademark rights. In this project, the provisions which protects trademark rights with criminal rules and specifically the provisions related with trademark offenses regulatedby the Law of Industrial Property (Law No 6769) are examined.
